332 <br />REGULAR MEETING <br />APPROVE LICENSE APPLICATIONS <br />JUNE 21, 1982 <br />The following Open Air Stand License applications were submitted <br />to the Board for approval: <br />J. V. Peacock - 4615 Miami Road <br />Edward Zick - southeast corner Ireland & U.S. 31 <br />Mr. Leszczynski noted that all locations were approved for <br />proper zoning, permission from the property owners to use the <br />lots had been obtain, and the Bureau of Traffic and Lighting. <br />had no objectors to the location of the stands provided they <br />remained off public right-of-way, were back for enough onto <br />the private property and at least one off_ -street parking <br />space was provided on private property. Mr.,Leszczynski <br />stated that the licenses were requested for the sale of fire- <br />works, and an inspection would be conducted by the Fire Prevention <br />Bureau to confirm that all fireworks being sold were legal fire- <br />works in Indiana. Upon a motion made by Mr. Leszczynski, <br />seconded by Mr. Hill and carried, the license applications were <br />appoved and referred to the Deputy Controller's Office for <br />issuance. <br />AMEND RESOLUTION NO. 15, 1982, ADOPTED ON MAY 24, 1982 - APPROVING <br />SCRAP DEALER'S LICENSE TO HERMAN WILLIAMS, D/B/A SOUTH MAIN AUTO PARTS <br />Mrs. Pfotenhauer explained that, following the Board meeting of <br />May 24, 1982, and the adoption of Resolution No. 15, 1982, approving <br />the issuance of a scrap dealer's license to Mr. Herman Williams, <br />d/b/a South Main Auto Parts, 1819 South Main,Street, the matter <br />had been referred to the Common Council for concurrence. She <br />advised that some questons had been raised by the Council con- <br />cerning the actual issuance of the license and compliance with <br />certain requirements for the establishment of a buffer strip <br />and fencing. Mrs. Pfotenhauer stated that all technical <br />requirements have been met; however, Mr. Williams does not as <br />yet have access to the property to make the required changes <br />regarding a buffer strip and his purchase of the property was <br />contingent upon approval of a scrap dealer's license. He <br />stated further that the amended Resolution No. 15, 1982, <br />provides specifically that the license be approved but not <br />issued until all requirements of the licensing ordinance are <br />met. Upon a motion made by Mr. Leszczynski, seconded by Mr. <br />Hill and carried, Resolution No. 15, 1982; adopted on May 24, <br />1982, was amended as follows: <br />AMENDED <br />RESOLUTION NO. 15. 1982 <br />WHEREAS, a license application for operation of a scrap <br />yard has been submitted to the Board of Public Works by <br />Herman T. Williams, d/b/a South Main Auto Parts, for <br />property located at 1819 South Main Street, as shown on <br />the attached diagram; and <br />WHEREAS, the property is now licensed as a scrap yard <br />under a license issued to South Bend Auto Parts (Charles <br />Rhoades) on February 5, 1982; and Mr. Williams is in the <br />process of purchasing said property for the continued <br />operation of a scrap yard under the name of South Main <br />Auto Parts, said purchase being contingent upon issuance <br />of said license by the City of South Bend; and <br />WHEREAS, in accordance with Ordinance No. 6998-81 which <br />licenses such operations, inspections of the property were <br />conducted by the Neighborhood Code Enforcement Office and <br />the Fire Prevention Bureau on May 6, 1982, and May 13, 1982, <br />respectively; and <br />
