73 <br />REGULAR MEETING <br />SEPTEMBER 28, 1981 <br />3. The appraisal determined market value with the <br />assumption that it was re -zoned "light industrial" <br />and that the highest and best use was in an arms length <br />transaction, which was for use by Lock Joint Tube. <br />4. What assurances does Lock Joint Tube have, if the purchase <br />is made, that the property will get rezoned. <br />5. If the land is not, rezoned, it will be useless to Lock <br />Joint Tube in its expansion plans. <br />6. Due to time limitations, Lock Joint Tube was unable to <br />furnish its own independent formal appraisal of the land. <br />It was noted that the specifications state that the Board shall <br />award the sale of the property to the highest and best bid equal <br />to not less than the offering price, which was established at <br />$18,250.00. Mr. Hill stated that it appeared there were some <br />unresolved issues as indicated in Mr. Woodka's letter. He stated <br />that the appraiser must be a free holder in South Bend, and it was <br />confirmed that this was the case and that, in addition to Mr. <br />McClosky's South Bend office, he also maintained an office in <br />Niles, Michigan. Mr. Hill made a motion that the bid of Lock Joint <br />Tube in the amount of $11,430.00 be taken under advisement and <br />referred to the Legal Department, Engineering Office and Recevelopment <br />C9 Department for comments on how the Board should proceed in this matter. <br />Q APPROVAL OF ASSESSMENT ROLL NO. 2988 (IMPROVEMENT RESOLUTION <br />NO. 3501. 1980, HAWBAKER SANITARY SEWER PROJECT) <br />This being the date set, hearing was held on the Assessment Roll <br />for the Hawbaker Street Sanitary Sewer Project, authorized under <br />Improvement Resolution No. 3501, 1980, adopted by the Board on <br />November 3, 1980. The Clerk tendered proofs of publication of <br />notice in the South Bend Tribune and the Tri-County News which <br />were found to be sufficient. Mr. Kernan stated that the total <br />cost of the improvement as petitioned by residents on Hawbaker <br />Street was $39,991.38 with the amount to be assessed to the <br />city at $19,995.69. He stated that the preliminary assessment <br />roll indicated a total of $47,483.42, and the individual assess- <br />ments on the final roll had been adjusted accordingly to reflect <br />a reduction. Upon a motion made by Mr. Kernan, seconded by Mr. <br />Hill and carried, the assessment roll hearing was closed and <br />Assessment Roll No. 2988 was approved. <br />PUBLIC HEARING - IMPROVEMENT RESOLUTION NO. 3514, 1981 <br />(PRAIRIE AVENUE SANITARY SEWER PROJECT) <br />The public hearing on the construction of sanitary sewers on <br />Prairie Avenue, authorized under Improvement Resolution No. 3514, <br />1981, adopted by the Board on September 14, 1981, was held at this <br />time. The Clerk tendered proofs of publication of notice in the <br />South Bend Tribune and the Tri-County News which were found to <br />be sufficient. Mr. Kernan noted that the preliminary assessment <br />roll listed a total cost of the improvement at $23,191.34 and that, <br />unless more than 50% of the affected property owners objected to <br />the construction of the sewer, the Board would proceed to obtain <br />bids for its construction. There was no one present to speak <br />against the project. Upon a motion made by Mr. Kernan, seconded <br />by Mr. Hill and carried, the project was approved, the title sheet <br />was signed and the Clerk instructed to cause advertising for receipt <br />of sealed bids for the construction of the sewers. <br />AWARD BID - REROOFING OF FIRE STATIONS NO. 7 AND 10 <br />Fire Chief Timothy J. Brassell submitted his recommendation to the <br />Board for the award of the reroofing of Fire Station No. 7 to <br />Slatile Roofing in the amount of $19,200 for their alternate <br />No. 1; and the award for the reroofing of Fire Station No. 10 to <br />City Roofing in the amount of $6,100.00. Mr. Kernan explained <br />that a clerical error had been found in the bid of Slatile <br />Roofing and it was confirmed that the figures for the fire <br />stations had been reversed.
