REGULAR MEETING SEPTEMBER 14, 1981 <br />interested, or whose property is or will be affected by the <br />proposed improvement, on the question as to whether the special <br />benefits that will accrue to the property to be assessed, <br />abutting on the line of proposed sewer or drain, will be <br />equal to the estimated cost of the improvement. On the day <br />named, any and all interested persons who may appear before <br />the board shall have a full hearing on the question, and on <br />any matter pertaining to the proposed improvement. <br />The Clerk of the Board is hereby ordered to give notice <br />by two weekly publications of the time and place of hearing <br />of this resolution, in two newspapers representing the two <br />major political parties, the first publication to be not <br />less than ten (10) days before the date of hearing. <br />Adopted this 14th day of September, 1981. <br />BOARD OF PUBLIC WORKS <br />s/ John E. Byers, Clerk <br />FILING OF MAINTENANCE BOND - TOPSFIELD II <br />Mr. Leszczynski stated that the Board of Works had, at its meeting <br />held on August 31, 1981, accepted the filing of an Irrevocable <br />Letter of Credit for Romy Hammes, Inc., drawn on the St. Joseph <br />Bank and Trust Company in the amount of $3,455.00 in lieu of a <br />maintenance bond on the construction of curbs, pavement and sanitary <br />and storm sewers in Part One of the Topsfield II Subdivision. Mr. <br />Leszczynski stated that a Maintenance Bond covering the project <br />for a three year period to August 31, 1984, had now been received <br />and Romy Hammes had, therefore, requested the return of the Letter <br />of Credit. Upon a motion made by Mr. Kernan, seconded by Mr. <br />Leszczynski and carried, the Maintenance Bond was filed and the <br />Clerk was instructed to return the Irrevocable Letter of Credit <br />to William Farabaugh, attorney for Romy Hammes. <br />APPROVAL OF TITLE SHEETS <br />A title sheet was submitted for sewer and water improvements in <br />Farmington Square, Unit 8. Mr. Leszczynski stated that the water <br />improvements would be covered under Clay Utilities. Upon a <br />motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, <br />the title sheet was approved. <br />Mr. Leszczynski submitted a title sheet for the extension of <br />Sampson Street just south of Southern View. He explained that <br />the project called for the extension of Sampson Street for about <br />130 feet in order to provide a second entrance into the subdivision <br />at that location. Upon a motion made by Mr. Leszczynski, seconded <br />by Mr. Hill and carried, the title sheet was approved. <br />A title sheet for improvements on the Colfax Bridge was also sub- <br />mitted for Board approval. Mr. Leszczynski explained that the work <br />would be done through the State Highway Commission, however, the <br />city must approve the project by the signing of the appropriate <br />title sheet. Upon a motion made by Mr. Leszczynski, seconded by <br />Mr. Hill and carried, the title sheet was approved. <br />FILING OF ASSESSMENT ROLL - VACATION RESOLUTION <br />NO. 3512, 1981 (LUDWICK GRAPHICS) <br />John E. Leszczynski, City Engineer, filed an Assessment Roll with <br />respect to Vacation Resolution No. 3512, 1981, for the vacation of <br />the first alley southwest of LaPorte Avenue running northwesterly <br />from Samcome Avenue; thence southwesterly to Wilbur Street, all <br />
