<br />adjustments in sewer and water castings. Mr. Leszczynski advised
<br />that the new contract sum, including this change order, was
<br />$27,791.00. Upon a motion made by Mr. Leszczynski, seconded by
<br />Mr. Kernan and carried, the above change order was approved.
<br />APPROVE REDUCTION OF LETTER OF CREDIT (ERSKINE MANOR)
<br />AND ACCEPT WARRANTY DEED FOR RETENTION BASIN
<br />Mr. Leszczynski stated that Mr. Kent Kaser had requested the Board
<br />of Works to reduce the Irrevocable Letter of Credit which had been
<br />submitted in lieu of a Maintenance Bond on the development of the
<br />Erskine Manor, Section 1, single-family residential project. He
<br />stated that the Board, on August 10, 1981, approved a reduction
<br />in the previously filed Letter of Credit to $270,090.00. Mr.
<br />Kaser was now requesting a further reduction to $36,650.00 based
<br />on estimated reconstruction costs. Mr. Leszczynski recommended a
<br />reduction in the letter of credit to $45,813.00. Upon a motion
<br />made by Mr. Leszczynski, seconded by Mr. Hill and carried, the
<br />Board approved a reduction in the Letter of Credit for the American
<br />National Bank and Trust Company to $45,813.00.
<br />A Warranty Deed from the Sisters of the Holy Cross conveying property
<br />to the City of South Bend for a retention basin in Section 1 of
<br />Erskine Manor Estates was submitted and accepted by the Board.
<br />FILING OF PETITION, ASSESSMENT ROLL AND PLANS, AND ADOPTION OF
<br />IMPROVEMENT RES. NO. 3514, 1981 (BARRETT LAW SANITARY SEWER - PRAIRIE AVE.)
<br />A petition submitted by property owners on Prairie Avenue was filed
<br />with the Board for the installation of sanitary sewer on the south
<br />side of Prairie near Olive Street. Mr. Leszczynski stated that, if
<br />approved, the sewer would be extended and property owners able to
<br />hook up to the sewer, the project to be covered under Barrett Law
<br />procedure at a preliminary cost estimate of $23,191.34. The Bureau
<br />of Design and Administration, in response to the petition, presented
<br />to the Board a preliminary assessment roll, estimate and plans for
<br />the project. Mr. Leszczynski noted that the amount estimated to be
<br />assessed to the city was $11,595.68. Upon a motion made by Mr.
<br />Kernan, seconded by Mr. Leszczynski and carried, the preliminary
<br />assessment roll, estimate and plans for the project were filed and
<br />the following Improvement Resolution No. 3514, 1981, was adopted
<br />and a public hearing on the proposed Improvement Resolution set
<br />for September 28, 1981:
<br />IMPROVEMENT RESOLUTION NO. 3514, 1981
<br />BE IT RESOLVED, by the Board of Public Works of the City
<br />of South Bend, Indiana, that it is deemed necessary to improve
<br />Prairie Avenue by the construction of a local sewer, intended
<br />and adapted only for local use by the property owners whose
<br />property abuts thereon and not intended or adapted for
<br />receiving sewage from collateral drains. Said sewer to be
<br />10 inches in diameter, and said sewer, with all its appurtenances,
<br />to be constructed in accordance with the profiles, drawings,
<br />plans, general details and specifications of such improvement
<br />approved and adopted herewith, and placed on file in the office
<br />of the Board of Public Works of said City, and such improvement
<br />is now ordered.
<br />The total cost of said improvement, including all incidental
<br />costs, such as advertising, abstracting, inspection and engineer-
<br />ing, shall be assessed upon the real estate abutting on said
<br />street in accordance with applicable statutes. The said
<br />improvement is to be financed and paid for as provided in
<br />Chapter 40, of the Acts of 1953, as amended (1971 I.C. 18-6-3).
<br />Assessments, if deferred, are to be paid in equal installments,
<br />with interest at the rate of eight (8) per cent per annum.
<br />The 28th day of September, 1981, at the hour of 9:30 a.m.
<br />o'clock, local time, is hereby fixed as the time and the Board
<br />of Public Works Hearing Room, Rm. #1308, County -City Building,
<br />as the place when and where the board will hear all persons
