60 <br />REGULAR MEETING SEPTEMBER 14, 1981 <br />Heating and H.R.D. Corporation for repair of the sewer immediately <br />since it was determined to be an emergency situation. Mr. Kernan <br />asked if other contractors could submit proposals for the repair <br />work, and Mr. Leszczynski stated that any contractor who was <br />interested could submit a proposal. Mr. Masters explained the <br />emergency powers delegated to the Board under such a situation, <br />advising that, according to the statutes, in cases of emergencies <br />such as equipment breakdown, etc. the Board was not obligated to <br />undergo the lengthy bid process but could instead invite <br />contractors to submit proposals if the situation was determined <br />to be an emergency. Upon a motion made by Mr. Leszczynski, <br />seconded by Mr. Hill and carried, the deteriorated sewer was <br />determined to be an emergency situation and the City Engineer was <br />instructed to proceed to obtain proposals for repair of the work <br />to be undertaken immediately. <br />AWARD BID AND APPROVE CONTRACT (CLEVELAND AND VAN BUREN <br />CURB & PAVEMENT IMPROVEMENTS) <br />Mr. Neil Shanahan, Manager of the Bureau of Public Construction, in <br />a letter to the Board recommended awarding the low bid of Rieth- <br />Riley Construction Company in the amount of $59,875.00 for the <br />Cleveland/Van Buren Curb and Pavement Project. It was noted that <br />bids for this construction had been received by the Board on August <br />31, 1981. Upon a motion made by Mr. Leszczynski, seconded by Mr. <br />Hill and carried, the low bid was accepted, a contract with Rieth- <br />Riley Construction was approved in the amount of $59,875.00, and <br />the necessary Performance and Labor and Materials Payment Bonds <br />were filed. <br />APPROVAL OF CHANGE ORDER NO. 1 AND PROJECT COMPLETION AFFIDAVIT - <br />IMPROVEMENT RESOLUTION NO. 3501, 1981 (HAWBAKER STREET SEWERS) <br />Mr. Leszczynski stated that Change Order No. 1 (Final) in the <br />amount of an increase of $8,228.73 was submitted on the Hawbaker <br />Street Improvement Project by H. DeWulf Mechanical Contractor for <br />necessary adjustments in work on sewer house leads, pavement and <br />sewer pipe. Also submitted was the Project Completion Affidavit <br />for the project indicating a final cost, including Change Order <br />No. 1, of $39,923.73. Mr. Leszczynski stated that the preliminary <br />estimate of project cost had been $47,483.42. Upon a motion made <br />by Mr. Leszczynski, seconded by Mr. Hill and carried, the Change <br />Order and Project Completion Affidavit were approved; the <br />Maintenance Bond on the project running to September 14, 1984, was <br />accepted and filed; and the Final Assessment Roll No. 2988 on the <br />project was filed and set for public hearing on September 28, 1981. <br />APPROVAL OF CHANGE ORDER NO. 3 - ST. JOSEPH VALLEY <br />STRUCTURAL STEEL (FIRST BANK CENTER) <br />Mr. Leszczynski stated that St. Joseph Valley Structural Steel <br />Corporation has submitted Change Order No. 3 to its contract for <br />structural steel on the First Bank Center Project in the amount of <br />an increase of $29,870.00, making the new contract sum $415,565.00. <br />He explained that originally it was thought only a primer coat would <br />be necessary on the steel; however, sufficient deterioration occurred <br />during the winter months to warrant a second painting of the steel <br />which resulted in the above change order. Upon a motion made by <br />Mr. Kernan, seconded by Mr. Hill and carried, the change order <br />was approved. <br />APPROVAL OF CHANGE ORDER NO. 1 - RIETH-RILEY <br />CONSTRUCTION (MICHIGAN STREET STORM SEWER) <br />Mr. Leszczynski advised that Rieth-Riley Construction Company had <br />submitted Change Order No. 1 to its contract on the Michigan Street <br />Storm Sewer Project in the amount of an increase of $8,480 for <br />additional work involving removal of wooden posts, conduit, walk <br />and curb, and the replacement of some new curbing and walks and <br />
