60 REGULAR MEETING SEPTEMBER 14, 1981 Heating and H.R.D. Corporation for repair of the sewer immediately since it was determined to be an emergency situation. Mr. Kernan asked if other contractors could submit proposals for the repair work, and Mr. Leszczynski stated that any contractor who was interested could submit a proposal. Mr. Masters explained the emergency powers delegated to the Board under such a situation, advising that, according to the statutes, in cases of emergencies such as equipment breakdown, etc. the Board was not obligated to undergo the lengthy bid process but could instead invite contractors to submit proposals if the situation was determined to be an emergency. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the deteriorated sewer was determined to be an emergency situation and the City Engineer was instructed to proceed to obtain proposals for repair of the work to be undertaken immediately. AWARD BID AND APPROVE CONTRACT (CLEVELAND AND VAN BUREN CURB & PAVEMENT IMPROVEMENTS) Mr. Neil Shanahan, Manager of the Bureau of Public Construction, in a letter to the Board recommended awarding the low bid of Rieth- Riley Construction Company in the amount of $59,875.00 for the Cleveland/Van Buren Curb and Pavement Project. It was noted that bids for this construction had been received by the Board on August 31, 1981. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the low bid was accepted, a contract with Rieth- Riley Construction was approved in the amount of $59,875.00, and the necessary Performance and Labor and Materials Payment Bonds were filed. APPROVAL OF CHANGE ORDER NO. 1 AND PROJECT COMPLETION AFFIDAVIT - IMPROVEMENT RESOLUTION NO. 3501, 1981 (HAWBAKER STREET SEWERS) Mr. Leszczynski stated that Change Order No. 1 (Final) in the amount of an increase of $8,228.73 was submitted on the Hawbaker Street Improvement Project by H. DeWulf Mechanical Contractor for necessary adjustments in work on sewer house leads, pavement and sewer pipe. Also submitted was the Project Completion Affidavit for the project indicating a final cost, including Change Order No. 1, of $39,923.73. Mr. Leszczynski stated that the preliminary estimate of project cost had been $47,483.42. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the Change Order and Project Completion Affidavit were approved; the Maintenance Bond on the project running to September 14, 1984, was accepted and filed; and the Final Assessment Roll No. 2988 on the project was filed and set for public hearing on September 28, 1981. APPROVAL OF CHANGE ORDER NO. 3 - ST. JOSEPH VALLEY STRUCTURAL STEEL (FIRST BANK CENTER) Mr. Leszczynski stated that St. Joseph Valley Structural Steel Corporation has submitted Change Order No. 3 to its contract for structural steel on the First Bank Center Project in the amount of an increase of $29,870.00, making the new contract sum $415,565.00. He explained that originally it was thought only a primer coat would be necessary on the steel; however, sufficient deterioration occurred during the winter months to warrant a second painting of the steel which resulted in the above change order. Upon a motion made by Mr. Kernan, seconded by Mr. Hill and carried, the change order was approved. APPROVAL OF CHANGE ORDER NO. 1 - RIETH-RILEY CONSTRUCTION (MICHIGAN STREET STORM SEWER) Mr. Leszczynski advised that Rieth-Riley Construction Company had submitted Change Order No. 1 to its contract on the Michigan Street Storm Sewer Project in the amount of an increase of $8,480 for additional work involving removal of wooden posts, conduit, walk and curb, and the replacement of some new curbing and walks and
