35 REGULAR MEETING AUGUST 10, 1981 APPROVAL OF KARATE DEMONSTRATION ON RIVER BEND PLAZA Ms. Mikki Dobski, River Bend Plaza Coordinator, submitted a request to the Board for permission to allow the Academy of Martial Arts to conduct a karate demonstration on River Bend Plaza in conjunction with the arts and craft fair to be held on August 13-14, 1981. Upon a motion made by Mr. Kernan, seconded by Mr. Hill and carried, the request was approved for August 13, 1981, during the lunch hour. NOTIFICATION OF INDIANA CABLEVISION RATE INCREASE FOR SPECIAL PROGRAMMING Mr. Leszczynski stated that Indiana Cablevision had notified the city of a planned rate adjustment for Indiana Cablevision Corporation's pay services which included Home Box Office and Showtime. He noted that, although the pay channels are excluded from rate regulation by local municipalities by the Federal Communications Commission, the notification was being sent so that the city may be better able to respond to any question it receives from its constituents. Mr. Leszczynski emphasized that the city has no jurisdiction in this rate increase but would file the correspondence as a matter of record and notification. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the correspondence was filed. FILING OF REPORTS AND ADOPTION OF VACATION RESOLUTION NO. 3512, 1981 (LUDWICK GRAPHICS) VACATION RESOLUTION NO. 3512, 1981 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: The lst alley southwest of LaPorte Avenue running northwesterly from Sancome Avenue; thence southwesterly to Wilbur Street, all being in Davis Plat to the City of South Bend, St. Joseph County, Indiana. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injuriously or beneficially affected by such vacation: Lots B,.C, D, E & F, in Davis Plat. Notice of this Resolution shall be published on the 14th & 21st day of August, 1981, in the South Bend -Tribune and in the Tri-County News. This Board, at its office, on the 31st day of August, 1981, at 9:30 o'clock, A.M., will hear and receive remonstrances from all persons interested in or affected by these proceedings.
