12 <br />REGULAR MEETING <br />JULY 20, 1981 <br />ADOPTION OF RESOLUTION NO. 16, 1981 - SCRAP DEALER'S LICENSE <br />(WEAVER TRUCK AND EQUIPMENT COMPANY) <br />RESOLUTION NO. 16, 1981 <br />WHEREAS, an application for a Scrap Dealer's License was sub- <br />mitted to the Board of Public Works on May 11, 1981, <br />on behalf of Weaver Truck and Equipment Company, <br />3700 Gertrude Street, South Bend, Indiana; and <br />WHEREAS, although Weaver Truck and Equipment is not considered <br />a junk dealer, the requirement for licensing the <br />premises as a scrap yard is based upon the nature <br />of the articles stored on the property rather than <br />the specific nature of the business being conducted; <br />and <br />WHEREAS, inspections of the property have been completed by <br />the Neighborhood Code Enforcement Office and the <br />Fire Prevention Bureau as required by Ordinance <br />No. 6621-79; and <br />WHEREAS, applicant has agreed to conform with all of the rules <br />and regulations as contained in said ordinance regard- <br />ing minimum lot area, fencing, no storage outside <br />fenced area and other regulations dealing with removal <br />and storage of materials, fire protection, health and <br />safety standards; and <br />WHEREAS, in accordance with Ordinance No. 6621-79, approval for <br />a scrap dealer's license shall be approved by the <br />Board of Public Works and the Common Council prior <br />to the issuance of said license by the City Controller. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of <br />the City of South Bend, Indiana, that the license applica- <br />tion of Weaver Truck and Equipment Company for the <br />issuance of a 1981 scrap dealer's license be approved. <br />BE IT FURTHER RESOLVED that this Resolution shall be subject to <br />approval and ratification by the Common Council. <br />Adopted: July 20, 1981 <br />ATTEST: <br />s/ Barbara J. Kernan <br />Mr. Hill stated that Weaver Truck and Equipment Company had been <br />approached regarding the issuance of a scrap dealer's license and, <br />although the firm was not engaged in the operation of a junk yard, <br />the requirement for licensing the premises as a scrap yard was <br />based upon the nature of the articles stored on the property rather <br />than the specific nature of the business being conducted. He advised <br />that the Neighborhood Code Enforcement Office and Fire Inspection <br />Bureau had submitted favorable recommendations and had advised <br />that all requirements stipulated by the Municipal Code had been <br />complied with. Upon a motion made by Mr. Hill, seconded by Mr. <br />Kernan and carried, the above resolution was adopted. Mr. Hill <br />stated that the matter would be forwarded to the Council for con- <br />currence prior to the issuance of the license by the Controller. <br />
