12
REGULAR MEETING
JULY 20, 1981
ADOPTION OF RESOLUTION NO. 16, 1981 - SCRAP DEALER'S LICENSE
(WEAVER TRUCK AND EQUIPMENT COMPANY)
RESOLUTION NO. 16, 1981
WHEREAS, an application for a Scrap Dealer's License was sub-
mitted to the Board of Public Works on May 11, 1981,
on behalf of Weaver Truck and Equipment Company,
3700 Gertrude Street, South Bend, Indiana; and
WHEREAS, although Weaver Truck and Equipment is not considered
a junk dealer, the requirement for licensing the
premises as a scrap yard is based upon the nature
of the articles stored on the property rather than
the specific nature of the business being conducted;
and
WHEREAS, inspections of the property have been completed by
the Neighborhood Code Enforcement Office and the
Fire Prevention Bureau as required by Ordinance
No. 6621-79; and
WHEREAS, applicant has agreed to conform with all of the rules
and regulations as contained in said ordinance regard-
ing minimum lot area, fencing, no storage outside
fenced area and other regulations dealing with removal
and storage of materials, fire protection, health and
safety standards; and
WHEREAS, in accordance with Ordinance No. 6621-79, approval for
a scrap dealer's license shall be approved by the
Board of Public Works and the Common Council prior
to the issuance of said license by the City Controller.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of
the City of South Bend, Indiana, that the license applica-
tion of Weaver Truck and Equipment Company for the
issuance of a 1981 scrap dealer's license be approved.
BE IT FURTHER RESOLVED that this Resolution shall be subject to
approval and ratification by the Common Council.
Adopted: July 20, 1981
ATTEST:
s/ Barbara J. Byers, Clerk
BOARD OF PUBLIC WORKS
s/ John E. Leszczynski, President
s/ Richard L. Hill
s/ Joseph E. Kernan
Mr. Hill stated that Weaver Truck and Equipment Company had been
approached regarding the issuance of a scrap dealer's license and,
although the firm was not engaged in the operation of a junk yard,
the requirement for licensing the premises as a scrap yard was
based upon the nature of the articles stored on the property rather
than the specific nature of the business being conducted. He advised
that the Neighborhood Code Enforcement Office and Fire Inspection
Bureau had submitted favorable recommendations and had advised
that all requirements stipulated by the Municipal Code had been
complied with. Upon a motion made by Mr. Hill, seconded by Mr.
Kernan and carried, the above resolution was adopted. Mr. Hill
stated that the matter would be forwarded to the Council for con-
currence prior to the issuance of the license by the Controller.
