260 REGULAR MEETING JUNE 13 , 1983 DENY SIDEWALK SALE PERMIT APPLICATION — OPEN DOOR RESCUE MISSION Mr. Leszczynski advised that a Sidewalk: Sale Permit application has been received from Mrs. Dale Holiday of the Open Door Rescue Mission, 104 East Broadway, South Bend, Indiana. The Mission is requesting permission to sell miscellaneous cloth- ing, household appliances, etc. on the sidewalk at 104_East Broadway on Tuesday and,"Friday of each week during the months of June, July and August. Mr. Hill advised that permits are typically issued to individuals wishing to conduct a sale for a designated period of time andnoton a continuing basis Because of the liability involved in the continuous use of the public right-of-way, upon a motion made by Mr. Hill, seconded by Mr. Kernan and carried, the above Sidewalk Sale Permit application was denied. APPROVE LICENSE APPLICATION - RUBBISH AND GARBAGE Mr. Leszczynski advised that a Rubbish and Garbage license application was received from Mr. Clarence Taylor, Sr.,.1635 South Franklin Street. It was noted that an inspection of the truck to be used had been conducted by the Solid Waste Bureau and it was found to beiin compliance. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the above _license application was approved and referred to the Deputy Controller's Office for issuance. APPROVE LICENSE APPLICATIONS - OPEN AIR STAND Mr. Leszczynski advised that the following Open Air Stand license applications have been received: . Mr. J.M. Quimby T-Shirts Plus 1118 Roberts Street South Bend, Indiana Stand to be located Dates: July 2 & 3, at: 333 W. Colfax 1983 Mr. G. John Fischer (Fischer's) Elephant Ears & Ethnic Foods 5026 Blackford East South Bend, Indiana Stand to be located at: 1135 Beyer Avenue Dates: 6/18/83, 7/2/83 & 7/16/83 He further advised that favorable recommendations were received from the Department of Code Enforcement and the Bureau of Traffic and Lighting. Mr. Fischer has additionally provided a letter from Mr. Robert C. O'Lena, Owner of Superior Muffler Centers, 1135 Beyer Avenue, South Bend, indicating that he has permission to use the above referred to property for the open air stand. It was noted that Mr. Quimby of T-Shirts Plus has not yet provided to the Board a letter from the property owner at 333 West Colfax granting permission for that location to be used. Upon a motion made by Mr. Hill, seconded by Mr. Leszczynski and carried, the above license applications were approved with the application of Mr. Quimby being approved subject to his filing a letter of consent from the property owner at 333 W. Colfax. REQUEST TO PURCHASE CITY -OWNED PROPERTY REFERRED (508 & 510 E. SOUTH) In a letter to the Board, Mr. Donald McManus, Southold Heritage Foundation, Inc. indicated Southold's interest in purchasing the city -owned. lots at 508 & 510 East South Street. They are interested in purchasing the property so that a house can be moved to that location. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the request was referred to the necessary City Departments and Bureaus for a determination as to whether or not the City need retain the lots for -any reason. 1 1 1
