REGULAR MEETING JUNE 6, 1983 Mr. Giltner, 2014 West Ford Street, South Bend,, spoke to the Board and asked what the neighbors can do next to stop the move. He stated that it was his impression that the public hearing being held today was for the purpose of discussing the houses being moved into the neighborhoods. He indicated that he considers himself and the other residents misinformed about the public hearing. He inquired of the Board what can be done as far as changing the zoning to not allow these houses into the neighborhoods Mr. Hill advised that an amendment to the City's zoning ordinance would be required in addition to discussions with the Area Plan Commission. He stated that it would be very unlikely that an amendment to the zoning ordinance would be approved in order to change the zoning for these structures. Mr. Kernan advised the residents that the County Commissioners will meet on Tuesday, June 7, 1983 at 10:00 a.m. and suggested that they appear at that meeting, as it is the proper forum for them to air the concerns they have. The residents were advised that the Board will notify the commissioners in writing of the concerns expressed by them at today's meeting and hopefully those concerns can be addressed by the commissioners. Mr. Kernan additionally advised Mr. Borek, as a representative of the neighbors, that perhaps it would be avisable to contact the County Commissioners office today and request permission to be placed on the agenda for the June 7th meeting. It was noted that the houses in question are publicly owned houses through HUD and the houses are to be place on county property. The houses, according to HUD requirements, cannot be demolished. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the public hearing on this matter was closed. Upon a motion made by Mr. Hill, seconded by Mr. Kernan and carried, the matter of the proposed house moves as stated above was deferred until next Monday's meeting and the Board will communicate in writing to the County Commissioners the concerns of the neighbors expressed at today's public hearing. PUBLIC HEARING AND RECOMMENDATION - VACATION OF 2ND N/S ALLEY W. OF HARRIS STREET FROM POLAND STREET S. TO THE E/W ALLEY S. OF POLAND Mr. Leszczynski advised that this was the date set for the Board's public hearing on the vacation of the second alley west of Harris Street running South from Poland Street to the intersecting east/west alley for a distance of 131 feet x 13 feet plus or minus lying between Lot 17 of Harris sub (7' R/W) and Lot 3 of Commissioners of Pt. B.O.L. 99 (6' R/W). This public hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Petition filed by El Campito, Inc., 1541 West Dunham Street, South Bend. Mr. Leszczynski advised that the affected property owners within 200 feet of the alley had been duly notified of the Board's public hearing date. The following recommendations on the proposed alley have been received: Community Development Department No objections to vacation of alley but service through the remaining alley would be.much easier if the garage that is located on N.E. corner on alley intersection were removed. Garage is owned by petitioner. Area Plan Commission Recommends that this alley be vacated, subject to -.any utility easements that may be required, and subject to additional land being dedicated at the alley intersection to better facilitate turning movements. If the north/south alley is vacated to Dunham Street also, the additional right-of-way dedication would not be necessary. G
