REGULAR MEETING JUNE 6, 1983 <br />Mr. Giltner, 2014 West Ford Street, South Bend,, spoke to the <br />Board and asked what the neighbors can do next to stop the <br />move. He stated that it was his impression that the public <br />hearing being held today was for the purpose of discussing <br />the houses being moved into the neighborhoods. He indicated <br />that he considers himself and the other residents misinformed <br />about the public hearing. He inquired of the Board what can <br />be done as far as changing the zoning to not allow these houses <br />into the neighborhoods Mr. Hill advised that an amendment to <br />the City's zoning ordinance would be required in addition to <br />discussions with the Area Plan Commission. He stated that it <br />would be very unlikely that an amendment to the zoning ordinance <br />would be approved in order to change the zoning for these <br />structures. <br />Mr. Kernan advised the residents that the County Commissioners <br />will meet on Tuesday, June 7, 1983 at 10:00 a.m. and suggested <br />that they appear at that meeting, as it is the proper forum <br />for them to air the concerns they have. The residents were <br />advised that the Board will notify the commissioners in writing <br />of the concerns expressed by them at today's meeting and hopefully <br />those concerns can be addressed by the commissioners. Mr. Kernan <br />additionally advised Mr. Borek, as a representative of the <br />neighbors, that perhaps it would be avisable to contact the <br />County Commissioners office today and request permission to be <br />placed on the agenda for the June 7th meeting. <br />It was noted that the houses in question are publicly owned <br />houses through HUD and the houses are to be place on county <br />property. The houses, according to HUD requirements, cannot be <br />demolished. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the public hearing on this matter was closed. <br />Upon a motion made by Mr. Hill, seconded by Mr. Kernan and <br />carried, the matter of the proposed house moves as stated <br />above was deferred until next Monday's meeting and the Board <br />will communicate in writing to the County Commissioners the <br />concerns of the neighbors expressed at today's public hearing. <br />PUBLIC HEARING AND RECOMMENDATION - VACATION OF 2ND N/S <br />ALLEY W. OF HARRIS STREET FROM POLAND STREET S. TO THE <br />E/W ALLEY S. OF POLAND <br />Mr. Leszczynski advised that this was the date set for the <br />Board's public hearing on the vacation of the second alley <br />west of Harris Street running South from Poland Street to the <br />intersecting east/west alley for a distance of 131 feet x 13 <br />feet plus or minus lying between Lot 17 of Harris sub (7' R/W) <br />and Lot 3 of Commissioners of Pt. B.O.L. 99 (6' R/W). This <br />public hearing is being held in order for the Board to submit <br />a recommendation to the Common Council concerning the Petition <br />filed by El Campito, Inc., 1541 West Dunham Street, South Bend. <br />Mr. Leszczynski advised that the affected property owners <br />within 200 feet of the alley had been duly notified of the <br />Board's public hearing date. The following recommendations <br />on the proposed alley have been received: <br />Community Development Department <br />No objections to vacation of alley but service through <br />the remaining alley would be.much easier if the garage that <br />is located on N.E. corner on alley intersection were <br />removed. Garage is owned by petitioner. <br />Area Plan Commission <br />Recommends that this alley be vacated, subject to -.any <br />utility easements that may be required, and subject to <br />additional land being dedicated at the alley intersection <br />to better facilitate turning movements. If the north/south <br />alley is vacated to Dunham Street also, the additional <br />right-of-way dedication would not be necessary. <br />G <br />
