�43 <br />REGULAR MEETING <br />JUNE 6. 1983 <br />It was noted -.that the properties to which the houses are <br />being moved have already been acquired and are owned by <br />the County. The residents attending the meeting were <br />advised to contact the St. Joseph County Commissioners <br />office and the Office of Housing and Urban Development <br />regarding their concerns. <br />Mr. Hill advised the residentsthatthe Board cannot deny <br />permission to conduct the move based on concernsother <br />than which the Board has legitimate authority to consider. <br />The process is geared so that construction companies wishing <br />to move a structure can request permission_ from the Board to <br />conduct the move. Based on recommendations from the Building <br />Department, the Bureau of Traffic and Lighting, a route being <br />approved and the appropriate Certificate of Insurance being <br />provided, the Board would consider the request. To deny <br />such a request based on how the housing will affect the <br />neighborhoods or the condition of the housing would con- <br />stitute illegal action by the Board. Again, residents were <br />urged to .take their concerns to the County Commissioners. <br />Mr. Hill advised that Lykowski Construction Company has <br />provided the City with a Certificate of Insurance and <br />that the Bureau of Traffic and Lighting has recommended the <br />route and made a judgment that it is safe to proceed with <br />the proposed moves. He further stated that in the past, <br />the Board.has asked for a modification in the routes to <br />be used if the public facilities located under the roadway <br />would be endangered. However, should any danage occur <br />during the move, the City is covered by the Certificate of. <br />Insurance for any repairs that need to be made. <br />Mr. Borek asked what the move is costing. Mr. Leszczynski <br />advised that that matter is of no concern to the Board and <br />that he does not have that information. Mr. Borek addition- <br />ally asked why the houses being mvoed were built in the first <br />place when it was anticipated that the overpass was going to <br />be built and the houses wouldhave to be moved sooner or <br />later. Mr. Leszczynski advised that he did not have an <br />answer to that question. It was determined that the <br />houses and the properties to which the houses are to be <br />moved are owned by the County. <br />Mr. Dan Chrzan, 2415 West Ford Street, South Bend, stated <br />that he is confident that the streets involved will be able <br />to handle the move but is concerned about the types of <br />housing being shoved into his neighborhood. Mr. Leszczynski <br />reiterated that the residents should communicate with the <br />County Commissioners and HUD regarding these concerns. <br />Mr. Hill advised that the zoning of the area was checked <br />and is appropriate for the houses to be moved to the <br />proposed locations. As long as zoning requirements are <br />met and all other Board requirements concerning the move, <br />the Board is forced to proceed on this issue on that basis. <br />Mr. Hill recommended that the Board defer action until next <br />Monday's meeting. At that time, the Board will recommend <br />that the request of Lykowski Construction Company to move <br />the houses be approved based on Lykowski meeting all <br />technical requirements. This short delay will enable the <br />residents involved to discuss the matter with the County <br />Commissioners. The houses will not be moved until final <br />Board approval. The Board again encouraged the residents <br />to take their very valid issues to the County officials. <br />Mr. Leszczynski will communicate in writing to the County <br />Commissioners the concerns expressed at this meeting and <br />encouraged the residents to do the same. <br />
