4j: <br />REGULAR MEETING <br />JUNE 6, 1983 <br />The regular meeting of the Board of Public Works was convened at <br />9:35 a.m, on Monday, June 6, 1983, by President John'E. <br />Leszczynski, with Mr. Leszczynski, Mr. Richard L. Hill and Mr. <br />Joseph E. Kernan present. Also present was Assistant City <br />Attorney Carolyn V. Pfotenhauer. <br />AGENDA ITEM STRICKEN <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the matter of the Sidewalk Sale Permit application <br />for Theodora T. Makielski, 1118 Woodward Avenue, South Bend, <br />Indiana, on behalf of Makielski, Inc., 117 North Main Street, <br />was stricken from the agenda. <br />MINUTES OF PREVIOUS 14EETING APPROVED <br />Upon a motion made by Mr. Kernan, seconded by Mr. Hill and <br />carried, the minutes of the May 31, 1983, regular meeting of <br />the Board.were approved. <br />PUBLIC HEARING - HOUSE MOVES TO 758 SO. CARLISLE, <br />754 S. CARLISLE, 2408 WEST FORD STREET AND -705 S. GRANT <br />Mr. Leszczynski advised that this was the date set for the <br />public hearing on the matter of four (4) house moves to the <br />following locations: 758 S. Carlisle, 754 S. Carlisle, 2408 <br />West Ford and 705 S. Grant. It was noted that the property <br />owners located within three hundred feet (300') of the proposed <br />locations of the moves were notified. It was additionally"noted <br />that the Bureau of Traffic and Lighting and the Building Depart- <br />ment have reviewed the request of Lykowski Construction Company, <br />21707 W. Ireland Road, South Bend, Indiana, to conduct the <br />proposed moves and have no objections. <br />Mr. Stanley Borek, 717 South Grant Street, South Bend, addressed <br />the Board concerning the house moves in question and asked why <br />the neighborhoods are being subjected to this type of housing <br />being put in their neighborhoods. He informed the Board that <br />the houses are boarded up and repairs are needed to the <br />interiors. He is concerned that taxpayers dollars will be <br />used to repair these houses which he considers a waste of <br />good money. <br />Ms. Carolyn V. Pfotenhauer, Board attorney, stated that the <br />Board has a limited authority in this matter. The Board is <br />concerned only with the technical aspects of the proposed move <br />which include the route to be used, whether or not the move <br />will endanger the streets or underground drainage system and <br />any other safety concerns involved in the move. The Board <br />cannot address whether or not the structure is appropriate <br />for the neighborhood. <br />Mr. Hill, in response to why the City doesn't move the houses <br />to property owned by the City on Olive Street, replied that <br />the houses being moved are not City property. The issue is <br />whether or not the public right-of-way can be utilized in <br />this matter and whether or not the move will endanger the <br />safety of the public right of way or other property. Mr. <br />Hill advised that the City has no ownership interest in the <br />houses and it would not be appropriate to place the houses <br />on city -owned property. He stated that the City has no desire <br />to sell the property in question on Olive Street. The houses <br />in question need to be moved because of construction relating <br />to the Olive -Sample overpass project. It was noted..that before <br />a permit can be issued to Lykowski Construction Company, Inc., <br />the zoning of the area to which the houses are to be moved <br />must be looked at and approved by the Building Department. <br />The Board of Public Works does not have authority to deny a <br />permit to move a structure based on the kinds of concerns <br />being brought to the Board today but must look strickly at <br />the technical requirements. <br />1 <br />
