127 <br />REGULAR MEETING FEBRUARY 21, 1983 <br />PUBLIC HEAPING - APPROVE VACATION OF ALLEY <br />1ST NORTH/SOUTH ALLEY WEST OF OLIVE <br />Mr. Leszczynski stated that this was the date set for the <br />Board's public hearing on the vacation of the 1st north/ <br />.south alley west of Olive Street running between Poland. <br />and Dunham except the 14 foot east/west right-of-way for <br />a distance of 260 feet all being in Summit Place 3rd Addition <br />to the City. of South Bend. This public hearing is being <br />held in order for the Board to submit a recommendation to <br />the Common Council concerning the Petition filed by Mr. <br />Philip 0. Berndt, 2413 West Dunham Street and Mr. David J. <br />Michaud, 2416 West Poland Street. Mr. Leszczynski advised <br />that the affected property owners within 200 feet of the <br />alley had been duly notified of the Board's public hearing <br />date. There was no one present at the public hearing to <br />speak against the"alley vacation and no written objections <br />were received. Mr. David J. Michaud, Petitioner, was present <br />at the public hearing and stated his support of ,the proposed <br />alley vacation. Favorable comments in support of the vacation <br />were received from the Engineering Department, Area Plan <br />Commission, Community Development Department and from Mr. <br />Robert J. Richardson, St. Joseph County Engineer. Upon a <br />motion made by Mr. Leszczynski, seconded by Mr. Kernan and <br />carried, the public hearing was closed and a favorable <br />recommendation for the vacation of the above alley was <br />forwarded to the Common Council, subject to the maintenance <br />of all utility easements. <br />APPROVE WARRANTY DEED —MARTIN BLAD FARMS, INC. <br />(ETHANOL PLANT PROJECT) <br />Mr. Leszczynski presented to the Board a Warranty Deed from <br />Martin Blad Farms, Inc. to the Civil City of South Bend for <br />a tract of land located in Section 21, Township 37.North <br />(T37N), Range 2 East (R2E), in St. Joseph County. This <br />property was needed for the installation of storm and <br />sanitary sewers. Upon a motion made by'Mr. Leszczynski, <br />seconded by Mr. Kernan and carried, the above referred to <br />Warranty Deed was approved. <br />APPROVE CHANGE ORDER NO. 3 - ETHANOL PLANT SITE DE -MUCKING <br />(WOODRUFF & SONS, INC.) <br />Mr. Leszczynski presented to the Board .Change Order No. 3 <br />for the ethanol plant site de -mucking. He stated that this <br />Change Order is based upon a request.by New Energy Corpora- <br />tion of Indiana and Davy -McKee that the limits of demucking <br />be extended. The Change Order calls for the contract to be <br />increased by $100,276.00, bringing the new contract sum <br />including this Change Order to $1,358,730.40; Upon a <br />motion made by Mr. Kernan, seconded by Mr. Leszczynski and <br />carried, the above Change Order was approved. <br />APPROVE REQUEST TO ADVERTISE FOR RECEIPT <br />OF BIDS SALE OF ABANDONED VEHICLES <br />Ms. Katherine Barnard, Director of the Department of Code <br />Enforcement, requested permission to advertise for the sale <br />of approximately twelve (12) abandoned vehicles, nine (9) <br />of which were valued at over One Hundred Dollars ($100.00) <br />and all of which were being stored at the Hurwich Impoundment <br />Lot, 1610 Circle Avenue. It was noted that all vehicles had <br />been stored more than the required thirty (30) days, identifica- <br />tion checks had been run for auto theft, and the owners and <br />lienholders notified. Upon a motion made by Mr. Leszczynski, <br />seconded by Mr. Kernan .and carried, the request was approved <br />and a date of March 7, 1983 was established for the receipt <br />of sealed bids.. <br />
