REGULAR MEETING NOVEMBER; 15. 1982 WHEREAS, in accordance with the above Plan, the City of South Bend requested the South Bend Community School Corporation, owner of the, Franklin School site, to convey to it a ten -foot wide strip of land adjacent to Marietta Street which presently forms a portion of the Franklin School site in order to facilitate the widening of Marietta Street,. which real property is more particularly described as follows: A parcel of land being a part of Edward H. Rush's First Addition and Rachel Gallagher's First Addition to.the City of South Bend, Indiana, and being more particularly described as follows, viz: Beginning at the point on intersection of the centerline of the now vacated Twenty foot (20') alley lying North of and adjacent to Lot Numbered One Hundred Twenty -Four (124) in said Rush's First Addition with the West right-of-way line of -Marietta Street (a Fifty foor (50;) right-of-way); thence South 00-03'-30" East, along said West right-of-way line, a distance of 581.33 feet to the Northerly right-of-way line of an Indiana State Highway Commission frontage road; thence Southwesterly along a curve to the right having a radius of 1327.39 feet, a central angle of Oo-27'-35", and limited in length by a chord of 10.65 feet which bears South 690-50'-24" West; thence North 00-03'-30" West, parallel with said West right-of-way line, a distance of 585.03 feet to said centerline of the vacated Twenty foot (20;) alley; thence South 890-48'-30" East, along said centerline, a distance of 10.00 feet (10') to the place of beginning; and A parcel of land being part of Rachel Gallagher's First Addition to the City of South Bend, Indiana, and being more particularly described as follows: Beginning at the point of intersection of the West right-of-way line of Marietta Street (a 60 feet right-of-way) and the Northerly right-of-way line of "Frontage Road" as defined by Indiana State Highway Commission Plans S.R. Drw. 11, U.S. Project 181. (6) 1962; thence Southwesterly along a curve to the right, said curve delineating said Northerly right-of-way of "Frontage Road", having a radius of 1327.39 feet, a central angle of 00-5l'-48" and limited in length by a chord of 20.00 feet which bears South 700-57'-25" West; thence Northeasterly a distance of 32.57 feet more or less to a point on the West right-of-way line of Marietta Street and 20.00 feet North of the point of beginning; thence South along the West right-of-way line of Marietta Street a distance of 20.00 feet to the point of beginning Subject to any easements, covenants or restrictions of record. WHEREAS, I.C. 36-1-11-8 provides that a transfer or exchange of property may be.made with a governmental entity upon the terms and conditions agreed by the entities as evidenced by adoption of a substantially identical resolution by each entity; and
