REGULAR MEETING NOVEMBER 15, 1982 WHEREAS, the South Bend Community School Corporation Board of School Trustees, on October 28, 1982, after conducting a public hearing and giving due notice pursuant to statutes, approved the transfer of this property to the City of South Bend by adopting the attached Resolution which is made a part hereof. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, that the City of South Bend, by and through its Board of Public Works, 'accept the conveyance of a ten -foot wide strip of land adjacent to Marietta Street, more particularly described above, from the South Bend Community School Corporation without the payment of any sum of money by the City of South Bend, subject to any easements, covenants or restrictions of record. Kernan RESOLUTION BE IT RESOLVED, that the City of South Bend, Indiana, has requested that South Bend Community School Corporation convey to it a ten foot wide strip of land adjacent to Marietta Street which presently forms a portion of the Franklin School site in order to facilitate the widening of Marietta Street, which real property is more particularly described in the deed which is attached to these minutes as Exhibit A and made a part hereof by reference; and WHEREAS the Superintendent of Schools has conducted a hearing pursuant to the requirements of I.C. 36-1-11-3 after giving notice under I.C. 5-3-1 and has approved the transfer of this property to the City of South Bend; NOW, THEREFORE, IT IS HEREBY RESOLVED, that South Bend Community School Corporation shall convey to City of South Bend, Indiana, by the Quit -Claim Deed (a copy of which is Exhibit A to these minutes), a ten foot wide parcel of property which presently forms a portion of the Franklin School site to facilitate the widening of Marietta Street without the payment of any sum of money by the City of South Bend, Indiana; and BE IT FURTHER RESOLVED, that this transfer is in the best interests of South Bend Community School Corporation since the widening of Marietta Street provides this building site with a better public street and also facilitates a better public street for other residents on Marietta Street; and BE IT FURTHER RESOLVED, that the President and Secretary of the Board of School Trustees are hereby authorized and directed to execute the Quit -Claim Deed for said property in the form prepared by the Assistant City Attorney of the City of South Bend, Indiana.
