424
REGULAR MEETING
NOVEMBER 13 , '19-84
Mr. Hill stated that the background check conducted by the South
Bend Police Department revealed a public intoxication charge on
April 13, 1984,but indicated no disposition. He asked Mr.
Brown if he recalled the circumstances surrounding this charge.
Mr. Brown advised that he did not recall any such charge in April
of 1984. He did state that there was a family dispute around
that time and it is possible that a member of his family could
have filed those charges against him. Mr. Hill advised that "no
disposition" indicates that the court has not taken action on the
charge and since they have not done so to date, they probably
would not.
NOTE: After the meeting of the Board, the Clerk of the Board of
Public Works was advised by the South Bend Police Department that
the 4-13-84 Public Intoxication charge indicating no disposition,
should have read 4-13-82 Public Intoxication - No disposition.
Mr. Hill stated that the concern of the Board is that the Board
has the publics' trust to screen applicants and to not put potential
passengers in any position of danger. He further stated that the
Board was concerned about Mr. Brown's past driving record and it
does appear that since 1982 Mr. Brown has not had any problems.
He further stated that the Board would be willing to give Mr.
Brown a chance. He cautioned Mr. Brown that should he have any
problems in the area of public intoxication or any moving violation
the Board would be in a position to take the taxicab driver's
license away. Mr. Hill stated that the Board would be obligated
to do that in the interest of public safety. Mr. Hill further
stated that Mr. Brown indicated that he has straightened out
his past problems and advised him that there is no room for arrest
or moving violations. Mr. Hill advised that it is his recommendation
that should there be any future problems the license be suspended
and taken away.
Therefore, upon a motion made by Mr. Hill, seconded by Mr.
Leszczynski and carried, the prior denial of the Taxicab Driver's
License for Mr. Brown was rescinded and the application approved.
Mr. Vance abstained from voting on this matter.
OPENING AND AWARD OF BIDS - SALE OF ABANDONED VEHICLES
This was the date set for the receiving and opening of sealed bids
for the sale of approximately sixteen (16) abandoned vehicles,
four (4) of which are valued at over 8100.00 and all of which have
been stored at South Bend Auto Parts, 1802 South Main Street, South
Bend, Indiana. The Clerk tendered proofs of publication of Notice
in the South Bend Tribune and the Tri-County News which were found
to be sufficient. The Department of Code Enforcement advised the
Board that vehicle Nos. 14, 15 and 16 should be removed from the
list of vehicles offered for sale as they are not yet ready to
be sold.
