423 <br />REGULAR MEETING <br />NOVEMBER 13, 1984 <br />The regular meeting of the Board of Public Works was convened <br />at 9:36 a.m, on Tuesday, November 13, 1984, by President John <br />E. Leszczynski, with Mr. Leszczynski, Mr. Richard L. Hill and <br />Mr.. Michael L. Vance present. Also present was Assistant City <br />Attorney Carolyn V. Pfotenhauer. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mr. Hill, seconded by Mr. Vance and carried, <br />the minutes of the November 5, 1984, regular meeting of the <br />Board were approved. <br />AGENDA ITEM STRICKEN <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the award of bid for two (2) slurry seal truck bodies <br />were stricken from the agenda as the bid received is still being <br />reviewed. <br />PUBLIC HEARING, RESCISSION OF PRIOR DENIAL AND APPROVAL OF <br />TAXICAB DRIVER'S LICENSE APPLICATION - JOSEPH E. BROWN <br />Mr. Joseph E. Brown, 23768 U.S. 20, Ct. 83, South Bend, Indiana, <br />appeared before the Board concerning the November 5, 1984, Board <br />denial of.his application for a Taxicab Driver's License. <br />Mr. Brown presented to the Board a letter from Steve Stacy, <br />President, Sodbusters, Inc. Landscaping, 10976 Anderson Road, <br />Granger, Indiana, advising that Mr. Brown was on their payroll <br />from May, 1984 to October, 1984 and during that time he was <br />found to be a hard worker and did a good job. Mr. Stacy further <br />advised in his letter that he would recommend Mr. Brown for <br />employment. <br />Mr. Brown stated that his driving record has been good for the <br />past two (2) years and acknowledged that he did have some <br />problems prior to that time. He further stated that last year <br />he did train with the Yellow Cab Company in order to learn how <br />to drive a taxicab and if this license should be granted he will <br />go through another training session. <br />Mr. Vance advised that as part of the application review process <br />a police background check had been conducted by the South Bend <br />Police Department. In reviewing that report, he observed a <br />reckless driving charge on December 26, 1982 and asked Mr. <br />Brown for the circumstances surrounding that charge. <br />Mr. Brown stated that it is his recollection that this charge <br />did take place in South Bend on Mayflower Road. He stated that <br />the vehicle in front of him was continually braking'so he <br />passed the car. In doing so, he was observed by the Indiana <br />State Police and pulled over and charged with reckless driving. <br />Mr. Vance advised that in further review of the application, <br />it was apparent that Mr. Brown did answer the questions <br />truthfully but he was concerned about the reference made in <br />the application to an aggravated assault charge in 1973 in <br />Florida and a felonies assault in April of 1982. <br />In response, Mr. Brown advised that the State of Florida does <br />not have a self defense law and therefore he was charged with <br />aggravated assault. The incident which occurred in 1982 which <br />he mentioned in his application took place in South Bend. He <br />advised that he stopped a man from beating his wife and there- <br />fore stopped the fight. He did, however, receive probation <br />in this incident. <br />
