REGULAR MEETING OCTOBER 15, 1984 <br />FILING OF HUMANE SOCIETY REPORT - SEPTEMBER <br />The Humane Society report for the month of September indicated <br />the following matters handled for the City of South Bend: <br />DOGS HANDLED: 269 <br />CATS HANDLED: 218 <br />OTHER ANIMALS HANDLED: 115 <br />BITE CASES HANDLED: 16 <br />COMPLAINTS HANDLED: 189 <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the above report as submitted was accepted and filed. <br />APPROVE CLAIMS <br />Ms. Jane Cleaver, Executive Director, St. Joseph County Job <br />Training Program, submitted two (2) lists containing sixty (60) <br />claims and recommended approval. Additionally, City Controller <br />Michael L. Vance submitted Claim Docket No. 19461 through Claim <br />Docket No. 19793 and recommended approval. Upon a motion made <br />by Mr. Vance, seconded by Mr. Hill and carried, the claims <br />were approved and the reports as submitted were filed. <br />PRIVILEGE OF THE FLOOR: <br />COMMENTS,AND QUESTIONS OF MR. JAMES CRONK REGARDING THE RECENT <br />TOWING OF TWO (2) BOATS AND TRAILERS FROM HIS PROPERTY AT 702 <br />EAST LA SALLE STREET BY THE DEPARTMENT OF CODE ENFORCEMENT <br />Mr. James Cronk, 702 East LaSalle Street, South Bend, Indiana, <br />was present at the meeting and addressed the Board. <br />Mr. Cronk stated that last week the Department of Code Enforce- <br />ment along with the City Attorney's office illegally removed <br />two (2) boats with trailers from his property at 702 East <br />LaSalle Street. He was requesting at this time that the Board <br />of Public Works require the Neighborhood Code Enforcement office <br />and the City to return the boats and trailers to his property. <br />He stated that if he understands correctly the procedure the <br />City used is not valid and in addition the City is attempting <br />to charge him for the police escort service required during the <br />towing of the vehicles as they were considered over -sized. Mr. <br />Cronk stated that the vehicles are not over -sized. <br />Mr. Hill advised Mr. Cronk that the reason he received the bill <br />was for the substantial cost to the City as a result of the <br />nuisance. <br />Mr. Cronk advised that per prior statements made by Mr. Richard <br />L: Hill, City Attorney, the boats/trailers were towed under the <br />abandoned -vehicle ordinance and he questions the truthfulness <br />of the City Attorney's statements. <br />Mr. Cronk further advised that he has checked with the City Clerk's <br />office and finds no record of a fee schedule for the towing of <br />vehicles and he cannot find a record of where the fee schedule <br />is filed and would like to know where it can be found. <br />Board Attorney Carolyn V. Pfotenhauer advised Mr. Cronk that <br />there is a state statute granting the City authorization to <br />collect for the towing of abandoned vehicles and the fee scheduled <br />is filed with the Board of Public Works, <br />Mr. Cronk further advised that he objects to the attempt the City <br />is making to charge him for storage fees for the storage of his <br />vehicles on a City impound lot which is not fenced -in and he <br />further stated that the vehicles are being stored unprofessionally. <br />
