170 <br />REGULAR MEETING <br />APRIL 1.6,.1984 <br />In response to Mr. Leszczynski's questions concerning the alley's <br />use by garbage trucks, Mr. Woodworth advised that garbage trucks <br />come into the alley off Hastings Street but have to back out in <br />order to leave as there is not sufficient room to turn around. <br />Mr. Vance and Mr. Leszczynski expressed their concerns regarding <br />this vacation as a portion of the adjoining north/south alley <br />has already been vacated and the closure of this east/west alley <br />as proposed would cause the north/south alley to become a 574 <br />foot long dead-end alley. Board members were concerned that the <br />other property owners affected would not have adequate access to <br />their garages. Board members acknowledged that the proper <br />procedure in filing the Petition and providing only the names <br />of the abutting property owners was followed but did have concerns <br />that the closing of this alley would cause a hardship on other <br />residents who use the alley for access to their garages. Board <br />members requested that the Petitioners notify their neighbors <br />that would be affected by this proposed vacation and advised <br />that those neighbors should be present at the Common Council <br />public hearing on this matter to speak either for or against the <br />vacation. <br />There being no one else present wishing to address the Board on <br />this matter, upon a motion made by Mr. Leszczynski, seconded by <br />Mr. Vance and carried, the public hearing on this matter was closed. <br />Based on the fact that Board members had concerns regarding other <br />neighbors possibly being affected but unaware of this proposed <br />vacation, upon a motion made by Mr. Leszczynski, seconded by Mr. <br />Vance and carried, the Clerk was instructed to forward to the <br />Common Council a letter indicating that the Board determined to <br />make no recommendation at this time and advised the Petitioners <br />to notify their neighbors concerning this vacation. <br />PUBLIC HEARING AND RECOMMENDATION - STREET VACATION <br />NORTH/SOUTH STREET KNOWN AS BUTTERNUT ROAD FROM THE <br />NORTH RIGHT-OF-WAY OF LATHROP STREET SOUTH TO THE <br />POINT OF PREVIOUS VACATION IN 1975 <br />Mr. Leszczynski advised that this was the date set for the Board's <br />public hearing on a proposed street vacation described as follows: <br />approximately three hundred ninety (390) lineal feet of Butternut <br />Road south of Lathrop Street. <br />It was noted that this public hearing is being held in order for <br />the Board to submit a recommendation to the Common Council con- <br />cerning the Petition filed by the St. Joseph County Airport <br />Authority, 4535 Terminal Drive, South Bend, Indiana. It was <br />noted that pursuant to South Bend Municipal Code Ordinance No. <br />7300-84, owners whose property abuts the proposed vacated <br />property.were notified of the Board's public hearing date. <br />Mr. John C. Schalliol, Airport Director, Michiana Regional Airport, <br />St. Joseph County Airport Authority, 4535 Terminal Drive, South <br />Bend, Indiana, was present and addressed the Board. Mr. Schalliol <br />advised that the portion proposed by this vacation was not part of <br />Butternut Road vacated in 1975 because at that time two (2) <br />businesses depended on it for access. However, since that time, <br />the Airport Authority has acquired both of those business sites. <br />Mr. Schalliol further stated that the vacation of this portion <br />of Butternut Road will allow the Airport Authority to relocate <br />their gates and fence and will improve security as well as <br />facilitate internal transportation between the tower and main- <br />tenance facility and perimeter checks. <br />Mr. Leszczynski advised that the Board has received favorable <br />comments regarding this vacation from the Engineering Department, <br />the Department of Code Enforcement and the Area Plan Commission. <br />I <br />
