REGULAR MEETING APRIL 16, 1984 <br />Mr. Ernest Lindstedt, President, Hablin Company, Inc., 229 <br />South Michigan Street, South Bend, Indiana and Mr. John Schmidt <br />for Crescent Realty, 439 East Colfax Avenue, South Bend, Indiana. <br />It was noted that pursuant to. South Bend Municipal Code Ordinance <br />No. 7300-84, owners whose property abuts the proposed vacated <br />property were notified of the Board's public hearing date. <br />Mr. Leszczynski advised that the Board has received comments <br />from various City departments and recommends the vacation of <br />this alley subject to the Petitioners dedicating to the City <br />additional right-of-way neededtoallow traffic to turn at the <br />intersection of the T-alley created by this vacation. <br />Mr. John Schmidt for Crescent Realty, 439 East Colfax Avenue, <br />South Bend, Indiana, one.of the Petitioners for this vacation, <br />was present and addressed the Board. Mr. Schmidt inquired as <br />to the procedure for determing what additional right-of-way the <br />City will be requiring. Mr. Leszczynski advised that the Engineer- <br />ing Department will work with the Petitioners to determine the <br />amount of right-of-way needed. <br />There being no one else present wishing to address the Board on <br />this matter, upon a motion made by Mr. Leszczynski, seconded by <br />Mr. Vance and carried, the public hearing on this matter was closed. <br />Further, upon a motion made by Mr. Leszczynski, seconded by Mr... <br />Vance and.carried, the Clerk was instructed to forward to the <br />Common Council a favorable recommendation on the above referred <br />to alley vacation subject to the City being provided the needed <br />right-of-way to allow traffic to turn at the intersection of the <br />T-alley created by this vacation, said legal description of <br />additional right-of-way to accompany this recommendation and <br />subject to any and all utility easements. <br />PUBLIC HEARING AND RECOMMENDATION - ALLEY VACATION <br />1ST EAST/WEST ALLEY NORTH OF HASTINGS STREET RUNNING WEST <br />FROM IRONWOOD TO THE INTERSECTING NORTH/SOUTH ALLEY <br />Mr. Leszczynski advised that this was the date set for the Board's <br />public hearing on the proposed alley vacation described as <br />follows: the first east/west alley north of Hastings. Street <br />running west from Ironwood a distance of 133.9' + to the inter- <br />secting north -south alley being between Lots 128 and 129 of <br />Hastings, Woodward and Gray's Addition to the City of South Bend. <br />It was noted that this public hearing is being held in order for <br />the Board to submit a recommendation to the Common Council con- <br />cerning the Petition filed by Mrs. Edna A. Woodworth, 529 South <br />Ironwood Drive, South Bend, Indiana and Mrs. Margaret L. Lebo, <br />603 South Ironwood Drive, South Bend, Indiana. It was noted <br />that pursuant to South Bend Municipal Code Ordinance No. 7300-84, <br />owners whose property abuts the proposed vacated property were <br />notified of the Board's public hearing date. <br />Mrs. Edna.A. Woodworth, 529 South Ironwood Drive, South Bend, <br />Indiana, and Mrs. Margaret Lebo, 603 South Ironwood Drive, South <br />Bend, Indiana, Petitioners in this proposed vacation were present. <br />Mrs. Woodworth advised members that the reason this vacation is <br />being requested is to eliminate a dangerous situation that exists. <br />She stated that when trains are across the Ironwood Grand Trunk <br />railroad crossing at the north end of the 500 block, motorists <br />create a traffic hazard by speeding into the east end of the <br />alley thinking they can continue north to Jefferson from the <br />West end of the alley. She stated that other cars enter the <br />north/south.alley from Hastings Street with the intent of doing <br />the same thing causing a hazardous situation. She stated that <br />this situation is very hazardous to the small children as well <br />as the property owners in the area. <br />
