REGULAR MEETING <br />MARCH 12, 1984 <br />Board Attorney Carolyn V. Pfotenhauer advised that the bid submitted <br />by Michiana Mack, Inc., 2802 Home Street, Mishawaka, Indiana did not <br />contain a signed Non -Collusion Affidavit. Upon a motion made by Mr. <br />Hill, seconded by Mr. Vance and carried, the bid of Michiana Mack, <br />Inc. was rejected as a result of the Non -Collusion Affidavit not <br />being executed. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance and <br />carried, the above two (2) bids were referred to Mr. Sean Watt, <br />Director, Division of Transportation, for review and recommendation. <br />PUBLIC HEARING AND APPROVAL - TAXICAB DRIVER'S LICENSE <br />APPLICATION (GREGORY K. ROUSE) <br />Mr. Gregory K. Rouse, 643 LaPorte, South Bend, Indiana, appeared <br />before the Board concerning the March 5, 1984 Board denial of <br />his application for a Taxicab Driver's License. <br />Mr. Rouse indicated that he wanted to bring to the Board's attention <br />the fact that in 1983 he was granted a Taxicab Driver's license <br />in good faith and he has done nothing to abuse that privilege. <br />Mr. Hill advised Mr. Rouse that the Board was aware that this was <br />a renewal application but the basis of the denial was the fact <br />that Mr. Rouse had two speeding convictions, one on January 17, 1983 <br />and the most recent on January 16, 1984. Mr. Hill further advised <br />that Mr. Vance's concern in recommending the denial of the license <br />was the second speeding ticket received in January of this year. <br />Mr. Rouse was asked if the ticket was received while driving a <br />taxicab and he indicated that it was. <br />Mr. Rouse advised members of the Board that he drives the car from <br />ten (10) to twelve (12) hours each day and he does not consider <br />it unusual to occasionally go above the speed limit taking into <br />account the number of hours he is driving a cab. He indicated <br />that he is not accident prone and has always paid any tickets <br />for any traffic infractions he has received. Mr. Rouse further <br />advised that driving a taxicab is the only livelihood he has to <br />care for his family. <br />Mr. Leszczynski advised Mr. Rouse that passengers using taxicabs <br />expect the drivers to be model drivers. Mr. Rouse stated that <br />he understands that expectation but stated that he does not <br />consider two (2) speeding tickets in fourteen (14) months a bad <br />record and he too is concerned about the tickets as they add <br />points to his driving record which he does not wish to accumulate. <br />Mr. Vance stated that it is not his intent to take away Mr. Rouse's <br />livelihood as a cab driver. However, he stated that renewals do <br />come through where drivers manage not to receive any tickets <br />throughout the year and the denial of the license affords Mr. <br />Rouse an opportunity to come before the Board and explain the <br />situation. Mr. Vance advised Mr. Rouse that the applications <br />come to him for a decision prior to action being taken by the <br />Board of Public Works. Mr. Vance asked Mr. Rouse if his license <br />has ever been suspended and Mr. Rouse answered no to that question. <br />Upon a motion made by Mr. Hill, seconded by Mr. Leszczynski and <br />carried, the previous decision of the Board to deny Mr. Rouse <br />a Taxicab Driver's license was rescinded and he was granted a <br />renewal license. Mr. Hill advised Mr. Rouse that if he received <br />any additional speeding citations during 1984, the Board would <br />be in a position to revoke the license. Mr. Vance abstained <br />from voting. <br />
