ME REGULAR MEETING NOVEMBER 28, 1983 approved and the matter referred to the City Attorney's office for the drafting of the appropriate Quit -Claim Deed._ APPROVE FINDINGS OF FACT-- PEDDLERS LICENSE REVOCATION (ANTHONY MC LEOD/JUNIOR CAREERS) Mr. Leszczynski presented to the Board a document entitled "Findings of Fact" which was filed with the City Controller and Mr. McLeod pursuant to _Section 4-16(d) of. the South Bend Municipal Code as a result of the Public Hearing held on Monday, November 21, 1983, concerning the revocation of a Peddlers License issued to Junior Careers on September 16, 1983. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the "Findings of Fact" was approved. APPROVE COMMUNITY DEVELOPMENT ADDENDUM The following Community Development Addendum was presented to the Board for approval: ADDENDUM II RENEW, INC. ACQUISITION/REHABILITATION ACTIVITY Addendum II provides for a change in the timetable in that the activity shall commence on January 1, 1983 and shall continue to and include December 31, 1983. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the above Addendum was approved.and executed. APPROVE EASEMENT FOR GAS MAINS - NORTHERN INDIANA PUBLIC SERVICE COMPANY (ETHANOL PLANT PROJECT) Mr. Leszczynski presented to the Board an Easement for Gas Mains with the Northern Indiana Public Service Company granting them access to City property to install and maintain its facilities to service the ethanol production facility. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the above Easement was approved. APPROVE CHANGE ORDER NO. 1 (FINAL) AND PROJECT COMPLETION AFFIDAVIT - MANHOLE RESTORATION PROJECT (SOUTH MAIN STREET) - PRESSURE CONCRETE CONSTRUCTION COMPANY Mr. Leszczynski advised that Pressure Concrete Construction Company, 315 South Court Street, Florence, AL has submitted Change Order No. 1 (Final) indicating that the contract amount be.increased by $17,951.40 for a new contract sum including this Change Order in the amount of $49,085.40. Mr. Leszczynski advised that the increased cost is due to the addition of manholes to the project. Additionally submitted was the Project Completion Affidavit indicating this new final cost. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, Change Order No. 1 (Final) and the Project Completion Affidavit were approved subject to the filing of the appropriate three-year Maintenance Bond. APPROVE CHANGE ORDERS NO. 10 & 11 - COLFAX AVENUE BRIDGE PROJECT (BATES AND ROGERS CONSTRUCTION) Mr. Leszczynski advised that Bates and Rogers Construction Company has submitted Change Order No. 10 (Extra Work Agreement) in the amount of $450.00 for nursery sod. The Change Order is necessary in order to complete the job without having to place seed out of season. Additionally submitted was Change Order No. 11 in a decreased amount of $225.00 which is for the elimination of mulch seeding "RV" due to the request of placing sod as stated in Change Order No. 10. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the above Change Orders No. 10 & 11 were approved. 1 1
