Hill, City Attorney <br />s/Michael L. Vance, City Controller <br />s/Sandra M. Parmerlee, Clerk <br />APPROVE AGREEMENT BETWEEN OWNER AND ARCHITECT - CITY OF SOUTH <br />BEND/JAMES E. CHILDS & ASSOCIATES, INC. (PALAIS ROYALE) <br />Submitted to the Board for approval was the Standard Form of <br />Agreement Between Owner (City of South Bend) and Architect (James <br />E. Childs & Associates, Inc.) for the renovation of the Palais <br />Royale Building to include approximately 20,850 square feet for <br />use by the Morris Civic Auditorium and related activities. <br />Improvements at the second floor mezzanine areas will reflect <br />proposed use requirements for banquets, rehearsals and receptions <br />in the renovated ballroom, the construction of new rest rooms (at <br />both the first and second floors), office and storage facilities, <br />dressing rooms and kitchen. First floor improvements <br />(approximately 3,500 square feet) will include a new box office, <br />Morris Civic Auditorium offices, miscellaneous offices, as well as <br />an elevator providing access to the second floor. <br />Compensation shall be based on a percentage of construction cost <br />of 8.6% under a maximum of five (5) separate prime construction <br />contracts. In the event that it is determined that prime <br />construction contracts in excess of five (5) will be required, the <br />architect's basic compensation will be increased by 0.25% for each <br />prime construction contract in excess of five (5). <br />Board Attorney Carolyn V. Pfotenhauer advised that the Agreement <br />has been reviewed and revised by the City Attorney's office and is <br />now ready for approval. Therefore, upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Vance and carried, the Agreement as <br />submitted was approved and executed. <br />ACCEPT FOR FILING DEDICATION OF PUBLIC RIGHT-OF-WAY (WEST ONE-HALF <br />OF IVY ROAD BETWEEN STATE ROAD 23 AND EDISON ROAD <br />Mr. Leszczynski advised that the Board has received from The <br />University of Notre Dame Du Lac of St. Joseph County, owners of <br />real estate within the City of South Bend, a Dedication of Public <br />Right -of -Way which grants, dedicates and conveys to the City of <br />South Bend, in perpetuity, for itself and the general public, for <br />all purposes including use as a public right-of-way, a parcel of <br />land located between State Road 23 and Edison Road in the <br />Northeast Quarter of Section 6, Township 37 North, Range 3 East, <br />commonly known as the West one-half of Ivy Road and more <br />particularly described in the legal description contained in the <br />"Dedication of Public Right-of-way document. <br />It was noted that on July 2, 1984, the Board accepted a Dedication <br />of Public Right -of -Way from Joseph and Phyllis Catanzarite and <br />Patrick J. Oliva for the east one-half of Ivy Road between South <br />Bend Avenue and Angela. The entire road is now public <br />right-of-way. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the Dedication of Public Right -of -Way for the west <br />one-half of Ivy Road, as described above, was accepted and filed. <br />
