Parmerlee, Clerk <br />ADOPTION OF RESOLUTION NO. 8-1985 - DESIGNATING A CERTAIN PORTION <br />OF PUBLIC RIGHT-OF-WAY FOR USE AS A PART OF THE EAST BANK TRAIL <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance and <br />carried, the following Resolution No. 8-1985 was adopted: <br />RESOLUTION NO. 8-1985 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />DESIGNATING A CERTAIN PORTION OF <br />PUBLIC RIGHT-OF-WAY FOR USE AS <br />A PART OF EAST BANK TRAIL <br />WHEREAS, the Board of Public Works of the City of South <br />Bend has authority over and the right to regulate the use <br />of public rights -of -way within the City of South Bend; and <br />WHEREAS, the Board of Park Commissioners of the City of <br />South Bend has applied to the Department of Natural Resources <br />for a State administered Federal Land and Water Conservation <br />Grant with which to build a bicycle and jogging trail, known <br />as East Bank Trail, within the City of South Bend in conjunction <br />with the East Race Project; and, <br />WHEREAS, the Park Department right-of-way for the trail does <br />not presently connect with the East Race; and, <br />WHEREAS, the Department of Natural Resources requires that <br />the East Bank Trail connect with the East Race. <br />BE IT FURTHER RESOLVED by the Board of Public Works of the <br />City of South Bend that the following described public right- <br />of-way be designated as a temporary portion of the East Bank <br />Trail until such time as the alternative property connecting <br />the East Bank Trail with the East Race has been obtained by <br />the Board of Park Commissioners. <br />A strip or parcel of land in the South East and <br />South West (1/4) quarter sections of Section One (1), <br />T37N, R2E St. Joseph County, South Bend, Indiana being <br />(10) feet in width and lying adjacent to on the East <br />and South sides respectively of the following defined <br />line. (Containing approximately .466 acres.) <br />Commencing at the intersection of the north property <br />line of Lot 7 (Coquillards lst Add.) extended East and <br />the East right-of-way of an abandoned Michigan Central <br />Railway property, which point is the true point of <br />beginning for this line; thence Southerly along the <br />Westerly right-of-way of Niles Avenue and Niles Avenue <br />extended a total distance of 1,500 feet more or less to <br />the intersection of the North right-of-way of Madison <br />Street; thence West along the North right-of-way of <br />Madison Street a distance of 530 feet more or less to <br />the intersection of the reconstructed East Race property <br />adjacent to Cottrell's 2nd Add. to the City of South <br />Bend, which point is the termination of this line. <br />
