Parmerlee, Clerk ADOPTION OF RESOLUTION NO. 8-1985 - DESIGNATING A CERTAIN PORTION OF PUBLIC RIGHT-OF-WAY FOR USE AS A PART OF THE EAST BANK TRAIL Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance and carried, the following Resolution No. 8-1985 was adopted: RESOLUTION NO. 8-1985 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, DESIGNATING A CERTAIN PORTION OF PUBLIC RIGHT-OF-WAY FOR USE AS A PART OF EAST BANK TRAIL WHEREAS, the Board of Public Works of the City of South Bend has authority over and the right to regulate the use of public rights -of -way within the City of South Bend; and WHEREAS, the Board of Park Commissioners of the City of South Bend has applied to the Department of Natural Resources for a State administered Federal Land and Water Conservation Grant with which to build a bicycle and jogging trail, known as East Bank Trail, within the City of South Bend in conjunction with the East Race Project; and, WHEREAS, the Park Department right-of-way for the trail does not presently connect with the East Race; and, WHEREAS, the Department of Natural Resources requires that the East Bank Trail connect with the East Race. BE IT FURTHER RESOLVED by the Board of Public Works of the City of South Bend that the following described public right- of-way be designated as a temporary portion of the East Bank Trail until such time as the alternative property connecting the East Bank Trail with the East Race has been obtained by the Board of Park Commissioners. A strip or parcel of land in the South East and South West (1/4) quarter sections of Section One (1), T37N, R2E St. Joseph County, South Bend, Indiana being (10) feet in width and lying adjacent to on the East and South sides respectively of the following defined line. (Containing approximately .466 acres.) Commencing at the intersection of the north property line of Lot 7 (Coquillards lst Add.) extended East and the East right-of-way of an abandoned Michigan Central Railway property, which point is the true point of beginning for this line; thence Southerly along the Westerly right-of-way of Niles Avenue and Niles Avenue extended a total distance of 1,500 feet more or less to the intersection of the North right-of-way of Madison Street; thence West along the North right-of-way of Madison Street a distance of 530 feet more or less to the intersection of the reconstructed East Race property adjacent to Cottrell's 2nd Add. to the City of South Bend, which point is the termination of this line.
