0 <br />REGULAR MEETING <br />JANUARY 28, 1985 <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the above Contracts and Addenda were approved and <br />executed. <br />APPROVE AUTHORIZATION OF POWER OF ATTORNEY FOR REVENUE RULING <br />REQUEST (PALAIS ROYALE) <br />Mr. Richard L. Hill, City Attorney, requested that the Board give <br />him authorization as City Attorney to execute Department of the <br />Treasury, Internal Revenue Service Form 2848 known as Power of <br />Attorney and Declaration of Representative, requesting a ruling by <br />the Internal Revenue Service that contributions to the City for <br />the purpose of the Morris Civic Auditorium expansion into the <br />Palais Royale building are tax deductible. Mr. Hill additionally <br />submitted two (2) other letters making certain representations and <br />requests which would also be executed by him as City Attorney. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, Mr. Hill was authorized to execute IRS Form 2848 Power of <br />Attorney and Declaration of Representative. <br />ADOPTION OF RESOLUTION NO. 3-1985 - DISPOSAL OF OBSOLETE VEHICLE <br />(POLICE DEPARTMENT) <br />In a letter to the Board, Police Chief Charles T. Hurley, advised <br />that damages recently incurred to Mechanical #734 of the Police <br />Department vehicle fleet exceeds the value of the unit. However, <br />the Department must keep the unit until restitution is made or <br />pending the outcome of any possible litigation. He advised that <br />this vehicle should be removed from the Vehicle Inventory. Upon <br />a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the following Resolution No. 3-1985 was adopted: <br />RESOLUTION NO. 3-1985 <br />WHEREAS, it has been determined by the Board of Public Works <br />that the following Police Department vehicle has recently <br />sustained damages which exceeds the value of the unit: <br />POLICE DEPARTMENT - 1977 FORD GRANADA (BROWN) <br />MECHANICAL # 734 <br />Serial No. 7W81L121413 <br />WHEREAS, Indiana Code 36-1-11-6 permits the disposal of <br />personal property no longer needed or obsolete. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of <br />the City of South Bend that the vehicle listed above is damaged <br />beyond repair and not needed by the City of South Bend. <br />BE IT FURTHER RESOLVED that the Bureau of Vehicle Maintenance <br />be authorized to dispose of said vehicle and to remove same from <br />the City Vehicle Inventory. <br />ADOPTED this 28th day of January, 1985. <br />BOARD OF PUBLIC WORKS <br />s/John E.
