REGULAR MEETING SEPTEMBER 9, 1986
()5
In response to Board Attorney Thomas Bodnar's question to Mr. May
inquiring whether or riot there, were any violations that weren't
listed on the application, Mr. May stated that there were three
(3) times since the 1970's with each time being borderline in
which he paid the fine. He stated that he was involved in an
accident while driving a taxicab in either 1972 or 1973 but there
was no personal injury.
Mr. Vance inquired of Mr. May whether he had any recent
violations. Mr. May responded by advising that there was a
reckless driving charge in 1986. He stated that at that time he
was involved in an argument with his wife and was charged with
driving under the influence and his license was suspended.
However, that charge was later changed to reckless driving.
In response to a question by Ms. Barnard, Mr. May advised that he
attended the Pathway Center program at the beginning of 1986.
Mr. Vance stated that it appears that Mr. May's license was
suspended until the middle of this year.
Mr. May stated that with a driving under the influence charge
licenses are automatically suspended. He stated, however, that
that DUI charge was dropped.
In response.to Ms. Barnard's inquiry, Mr. May advised that his
license came off suspension in May of 1986 with no violations
occurring after that, before or during that time.
Police Department Division Chief Donald Ruszkowski was present
and advised the Board that a review of Mr. May's background
revealed that there were three (3) different suspensions and a
six (6) point violation for reckless driving. Chief Ruszkowski
stated that it was his opinion that Mr. May has bad driving
habits, is a habitual traffic offender and will probably lose his
license again.
As a point of clarification, Mr. Ruszkowski stated that the six
(6) point violation occurred in Mishawaka, Indiana on April 14,
1986, for reckless driving. He further stated that after the
accumulation of ten (10) to twelve (12) points a driver loses his
license.
Ms. Barnard stated that it appears that Mr. May is not a safe
driver. Mr. Leszczynski stated that his chief concern is that a
taxicab driver deals with the public and the public relies on
that driver to provide safe service. Mr. Leszczynski advised Mr.
May that he is not adverse to reviewing and reconsidering his
application in one (1) year and and if there is a one (1) year
period of no violations the Board would reconsider the
application at that time.
Therefore, upon
a motion made by Ms.
Barnard, seconded by Mr.
Leszczynski, Mr.
Vance's prior denial
of the taxicab license for
Delmar May was
affirmed. Mr. Vance abstained
from voting on this
matter.
Mr. May thanked
this matter and
members of the Board
stated that he would
for hearing him regarding
"keep his nose
clean" and
reapply in one
(1) year.
APPROVE TITLE SHEET - ARCHI
I
Mr. Leszczynski advised that
bid packets for the baseball
at this time for execution.
Leszczynski, seconded by Mr.
referred to Title Sheet was
ECTURAL/MEP PACKAGE - STANLEY
STADIUM PROJECT
the Title Sheet for the remaining
stadium project was being presented
Upon a motion made by Mr.
Vance and carried, the above
approved and signed.
