REGULAR MEETING SEPTEMBER 9, 1986 <br />()5 <br />In response to Board Attorney Thomas Bodnar's question to Mr. May <br />inquiring whether or riot there, were any violations that weren't <br />listed on the application, Mr. May stated that there were three <br />(3) times since the 1970's with each time being borderline in <br />which he paid the fine. He stated that he was involved in an <br />accident while driving a taxicab in either 1972 or 1973 but there <br />was no personal injury. <br />Mr. Vance inquired of Mr. May whether he had any recent <br />violations. Mr. May responded by advising that there was a <br />reckless driving charge in 1986. He stated that at that time he <br />was involved in an argument with his wife and was charged with <br />driving under the influence and his license was suspended. <br />However, that charge was later changed to reckless driving. <br />In response to a question by Ms. Barnard, Mr. May advised that he <br />attended the Pathway Center program at the beginning of 1986. <br />Mr. Vance stated that it appears that Mr. May's license was <br />suspended until the middle of this year. <br />Mr. May stated that with a driving under the influence charge <br />licenses are automatically suspended. He stated, however, that <br />that DUI charge was dropped. <br />In response.to Ms. Barnard's inquiry, Mr. May advised that his <br />license came off suspension in May of 1986 with no violations <br />occurring after that, before or during that time. <br />Police Department Division Chief Donald Ruszkowski was present <br />and advised the Board that a review of Mr. May's background <br />revealed that there were three (3) different suspensions and a <br />six (6) point violation for reckless driving. Chief Ruszkowski <br />stated that it was his opinion that Mr. May has bad driving <br />habits, is a habitual traffic offender and will probably lose his <br />license again. <br />As a point of clarification, Mr. Ruszkowski stated that the six <br />(6) point violation occurred in Mishawaka, Indiana on April 14, <br />1986, for reckless driving. He further stated that after the <br />accumulation of ten (10) to twelve (12) points a driver loses his <br />license. <br />Ms. Barnard stated that it appears that Mr. May is not a safe <br />driver. Mr. Leszczynski stated that his chief concern is that a <br />taxicab driver deals with the public and the public relies on <br />that driver to provide safe service. Mr. Leszczynski advised Mr. <br />May that he is not adverse to reviewing and reconsidering his <br />application in one (1) year and and if there is a one (1) year <br />period of no violations the Board would reconsider the <br />application at that time. <br />Therefore, upon <br />a motion made by Ms. <br />Barnard, seconded by Mr. <br />Leszczynski, Mr. <br />Vance's prior denial <br />of the taxicab license for <br />Delmar May was <br />affirmed. Mr. Vance abstained <br />from voting on this <br />matter. <br />Mr. May thanked <br />this matter and <br />members of the Board <br />stated that he would <br />for hearing him regarding <br />"keep his nose <br />clean" and <br />reapply in one <br />(1) year. <br />APPROVE TITLE SHEET - ARCHI <br />I <br />Mr. Leszczynski advised that <br />bid packets for the baseball <br />at this time for execution. <br />Leszczynski, seconded by Mr. <br />referred to Title Sheet was <br />ECTURAL/MEP PACKAGE - STANLEY <br />STADIUM PROJECT <br />the Title Sheet for the remaining <br />stadium project was being presented <br />Upon a motion made by Mr. <br />Vance and carried, the above <br />approved and signed. <br />
