178 <br />REGULAR MEETING MAY 27. 1986 <br />Drive, P.O. Box 986, Mishawaka, Indiana 46544, in the amount of <br />$124,607.00, which includes Alternate No. 2, for the above <br />referred to Project be accepted, subject to funding. It was <br />noted that bids for the above referred to project were opened by <br />the Board on April 29, 1986. <br />In response to Ms. Barnard's inquiry regarding the cost to be <br />assessed per property owner, Mr. Leszczynski stated that the <br />final cost would be determined at the conclusion of the <br />construction of the project at which time a Final Assessment Roll <br />would be submitted to the Board for approval. However, it is <br />estimated that the approximate cost per lot will be $3,300.00. <br />It was further noted that thirteen (13) lots are affected by this <br />project. <br />Therefore, upon a motion made by Mr. Leszczynski, seconded by Ms. <br />Barnard and carried, the determination of the Board as outlined <br />above was accepted and approved and the award of the bid was <br />approved subject to funding and to the filing of the appropriate <br />Insurance, Performance Bond and Labor and Materials Payment Bond <br />by the Contractor. <br />In response to a question from the news media, Mr. Leszczynski <br />stated that the City will be responsible for the cost of the <br />construction of the lift station. <br />Mr. Leszczynski thanked Mr. Wayne Werts, 1889 Riverside Drive, <br />and Mr. Joseph Klebosits, 1905 Riverside Drive, for working with <br />the Board in resolving this matter and supplying pertinent data <br />and information for the Board's review. <br />Mr. Wayne Werts, 1889 Riverside Drive, South Bend, Indiana, <br />asked Mr. Leszczynski if he correctly understood his comments <br />made earlier that the benefit of the project would be equal to <br />the cost of the project. Mr. Leszczynski stated that that was <br />correct and that the benefits would be equal to or exceed the <br />cost of the project. Mr. Werts responded by advising that that <br />statement is definitely in disagreement with the beliefs of the <br />affected property owners and in his particular case he will <br />realize zero benefits. <br />Mr. Werts further inquired if the affected property owners would <br />be notified of the impending construction. Mr. Leszczynski <br />stated that the property owners would be notified in writing <br />advising them of the construction as well as the date <br />construction is expected to begin. Mr. Leszczynski further <br />advised that the contractor, together with an inspector from the <br />Department of Public Works, will meet with each affected property <br />owner. <br />Councilman John Voorde inquired if the affected property owners <br />will have to pay to tie-in to the sewer line plus the <br />construction costs. Mr. Leszczynski advised that the cost of <br />connecting is between the individual property owner and whatever <br />contractor is hired by that property owner to do the work. In <br />response to Mr. Voorde's question regarding whether each property <br />owner will be required to tie-in to the sanitary sewer at the <br />completion of its construction, Mr. Leszczynski stated that that <br />is a legal question to which he does not have an answer at this <br />time. <br />APPROVE C <br />AFFIDAVIT <br />Sample Street, <br />No. 1 (Final) <br />$4,196.00 for <br />the amount of <br />lest <br />South Bend, Indiana, has submitted Change Order <br />indicating that the contract amount be increased <br />a new Contract sum including this Change Order in <br />$20,186.00.
