<br />The Railroad Agreement for the Olive Street at Conrail Crossing
<br />Reconstruction indicates that through the cooperation of the
<br />City, the State and the Federal Highway Administration, the above
<br />referred to project has been approved by the Federal Highway
<br />Administration for Federal Aid Funding. In his letter to the
<br />Board, Mr. Wheeler indicated that at this time, the Indiana
<br />Department of Highways has requested the Federal Highway
<br />Administration to obligate funds for the preliminary engineering
<br />phase of this project. A request to obligate the construction
<br />funds will be made after this Agreement between the City and the
<br />Railroad has been executed.
<br />Upon a motion made by Ms. Barnard, seconded by Mr. Vance and
<br />carried, the above referred to three (3) Agreements were approved
<br />and executed.
<br />APPROVE REQUEST TO ADVERTISE FOR RECEIPT OF BIDS - SALE OF
<br />ABANDONED VEHICLES
<br />Ms. Katherine Barnard, Director, Department of Code Enforcement,
<br />requested, permission to advertise for the sale of approximately
<br />eleven (11) abandoned vehicles which are being stored at Steve &
<br />Gene's Auto & Truck Salvage and Repair, 3109 South Gertrude
<br />Street, South Bend, Indiana. It was noted that all vehicles have
<br />been stored more than fifteen (15) days, identification checks
<br />had been run for auto theft and the owners and lienholders
<br />notified. Upon a motion made by Ms. Barnard, seconded by Mr.
<br />Vance and carried, the above request was approved and a date of
<br />April 8, 1986, was established for the receiving and opening of
<br />sealed bids.
<br />ACCEPT AND APPROVE EXTENSION OF OFFER TO PURCHASE CITY -OWNED
<br />PROPERTY AT THE N.W. CORNER OF LINCOLNWAY AND CHAPIN (INNERBELT)
<br />Mr. Leszczynski advised that Mr. Richard W. Morgan, Attorney at
<br />Law, Barnes & Thornburg, 600 1st Source Bank Center, 100 North
<br />Michigan Street, South Bend, Indiana, on behalf of his client,
<br />American Plasma Management, Inc., advised that American Plasma's
<br />zoning variance Public Hearing before the Board of Zoning Appeals
<br />has been rescheduled for the week of April 14, 1986. Therefore,
<br />he is requesting that the Board extend the purchase option with
<br />American Plasma relating to the above referred to property until
<br />April 30, 1986.
<br />Ms. Barnard advised that on January 28, 1986, the Board granted
<br />an extension until March 31, 1986 contingent upon approval by the
<br />Board of Zoning Appeals for use of the property as a parking
<br />lot. As the meeting of the Board of Zoning Appeals has been
<br />rescheduled due to the Easter holiday, Ms. Barnard made a motion
<br />that the Board accept and grant this additional extension as
<br />requested. Mr. Vance seconded the motion and it carried.
<br />APPROVE RELEASE OF MAINTENANCE BOND AND ACCEPTANCE OF CERTIFIED
<br />CHECK - MIAMI & IRELAND RETENTION POND REPAIRS PROJECT
<br />Mr. Leszczynski advised that Mr. Daniel Wineholt, Controller, L.
<br />Wolff Farms, Inc., P.O. Box 3, Union Mills, Indiana, submitted a
<br />Certified Check in the amount of $4,466.70 to replace the present
<br />Maintenance Bond which they submitted on August 17, 1984 for the
<br />above referred to project. He advised that this certified check
<br />covers the period beginning August 17, 1984 and will expire
<br />August 17, 1987. Board Attorney Thomas Bodnar advised the Board
<br />that he has reviewed this matter, discussed it with L. Wolff
<br />Farms and it is appropriate at this time for the Board to release
<br />the Maintenance Bond originally submitted and to accept the
<br />Certified Check in the amount of $4,466.70 in its place.
<br />Therefore, upon a motion made by Ms. Barnard, seconded by Mr.
<br />Vance and carried, the original Maintenance Bond was released and
<br />the Certified Check accepted.
