REGULAR MEETING <br />SEPTEMBER 15, 1987 <br />WHEREAS, at its September 14, 1987, meeting the South Bend <br />Common Council duly considered information from surveys and <br />studies conducted by the South Bend Department of Economic <br />Development and the Michiana Area Council of Governments <br />concerning the need for and proper location of parking facilities <br />in the central downtown area of the City of South Bend; and <br />WHEREAS, the South Bend Common Council adopted Resolution <br />No. 1533-87, a copy of which is attached hereto as Exhibit B and <br />incorporated fully herein, accepting and approving the <br />recommendations of the South Bend Board of Public Safety; and <br />WHEREAS, at its regular meeting held September 15, 1987, the <br />Board of Public Works received and filed plats and descriptions <br />of the land proposed to be acquired and used for a parking <br />facility; general plans or drawings of the proposed parking <br />facility; and a general estimate of the cost of acquisition, <br />construction, and installation of the parking facility. <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of <br />Public Works, as follows: <br />Section 1. The South Bend Board of Public Works (Board) <br />hereby approves the plats, descriptions, plans, drawings, and <br />estimates filed with it at this meeting for a parking facility of <br />approximately 440 spaces, to be constructed at the northwest <br />corner of East Wayne Street and South St. Joseph Street in the <br />central downtown area of the City of South Bend. <br />Section 2. The Board hereby declares that upon <br />investigation it has been found necessary for the proper <br />protection of the public safety and welfare and that it will be a <br />public utility and benefit to the City of South Bend and its <br />citizens to: <br />(a) Construct and maintain the parking facility <br />described in section 1 of this resolution; and <br />(b) Acquire for that purpose the following property <br />upon passage of a joint resolution by the Board and the <br />South Bend Redevelopment Commission, which use was <br />authorized for a parking structure by the South Bend Common <br />Council in its Resolution No. 1533-87, approved September <br />14, 1987: <br />A part of the Northwest Quarter of Section 12, <br />Township 37 North, Range 2 East of the Second <br />Principal Meridian, Portage Township, City of <br />South Bend, Indiana being a part of Lots Fifty <br />(50), and Fifty-one (51) and Fifty-two (52) of <br />the Original Plat of South Bend, Indiana more <br />particularly described as follows: Beginning at <br />the intersection of the Westerly right-of-way <br />line of St. Joseph Street (85 foot right-of-way) <br />with the North right-of-way line of Wayne Street <br />(82.5 foot right-of-way), thence South 89 38'12" <br />West (bearing assumed) along the North right-of-way <br />line of Wayne Street 148.84 feet; thence North <br />00 27'00" West, 186.00 feet; thence North 89 39'34" <br />East, 165.61 feet; thence Southwesterly 186.99 <br />feet along a segment of a curve to the right <br />having a radius of 912.43 feet, subtended by a <br />chord having a bearing of South 04 42'19" West <br />and a length of 186.66 feet to the point of <br />beginning. <br />Section 3. The Board, based upon the descriptions, plans, <br />drawings and estimates filed with it at this meeting, estimates <br />that the probable cost of construction of the parking facility of <br />approximately 440 spaces described in section 1 is Three Million <br />Six Hundred Thousand Dollars ($3,600,000) and proposes that the <br />
