REGULAR MEETING MAY 19, 1987 The first east/west alley south of Huron Street running East from Kosciuszko Street to the first north/south intersecting alley for a distance of 128.6 feet between lots 22 and 23 of J.M. Studebaker Sub of Lot 1 - Harper & Ruckmans survey to the City of South Bend, St. Joseph County, Indiana It was noted that this Public Hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petition filed by the following individuals: David A. Celmer 520 Kosciuszko Street Gail Marie Celmer 520 Kosciuszko Street Gregory Celmer 520 Kosciuszko Street Gertrude Botka 514 Kosciuszko Street Chester Botka 514 Kosciuszko Street It was noted that the above named individuals are the only property owners abutting the alley to be vacated. Mr. Gregory Celmer, Petitioner, 520 Kosciuszko Street, South Bend, Indiana, was present and advised the Board that the purpose of the vacation is to prohibit speeding cars from utilizing the alley and to insure the safety of the abutting property owners. Mr. Celmer further advised that property owners have experienced thefts and it is hoped that closing the alley will deter further thefts. Mrs. Gertrude Botka, also a Petitioner, 514 Kosciuszko Street, South Bend, Indiana, was present and stated that she has no objections to the vacation of this alley. In response to Mrs. Botka's questions, Mr. Vance advised that the portion of the vacated alley abutting her property will revert to her and in order to find out how much additional tax will be assessed, she should check with the Portage Township Assessor's Office. There being no one else present wishing to speak either for or against the proposed alley vacation, and no written objections having been filed with the Board, the Public Hearing on this matter was closed. Mr. Leszczynski advised that favorable comments have been received from the Engineering Department, Area Plan Commission and the Department of Community Development concerning this proposed alley vacation. Therefore, upon a motion made by Mrs. DeClercq, seconded by Mr. Vance and carried, the Clerk was instructed to forward to the Common Council a favorable recommendation on the above referred to alley vacation subject to any and all utility easements. OPENING AND AWARD OF BIDS - SALE OF ABANDONED VEHICLES This was the date set for the receiving and opening of sealed bids for the sale of approximately ten (10) abandoned vehicles which have been stored at Steve and Gene's Auto & Truck Salvage and Repair, 3109 South Gertrude Street, South Bend, Indiana. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News which were found to be sufficient.
