REGULAR MEETING <br />MAY 19, 1987 <br />The first east/west alley south of Huron Street running East <br />from Kosciuszko Street to the first north/south intersecting <br />alley for a distance of 128.6 feet between lots 22 and 23 of <br />J.M. Studebaker Sub of Lot 1 - Harper & Ruckmans survey to <br />the City of South Bend, St. Joseph County, Indiana <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to <br />the <br />Common Council <br />concerning the Vacation Petition filed <br />by the following <br />individuals: <br />David A. Celmer <br />520 <br />Kosciuszko <br />Street <br />Gail Marie Celmer <br />520 <br />Kosciuszko <br />Street <br />Gregory Celmer <br />520 <br />Kosciuszko <br />Street <br />Gertrude Botka <br />514 <br />Kosciuszko <br />Street <br />Chester Botka <br />514 <br />Kosciuszko <br />Street <br />It was noted that the above named individuals are the only <br />property owners abutting the alley to be vacated. <br />Mr. Gregory Celmer, Petitioner, 520 Kosciuszko Street, South <br />Bend, Indiana, was present and advised the Board that the purpose <br />of the vacation is to prohibit speeding cars from utilizing the <br />alley and to insure the safety of the abutting property owners. <br />Mr. Celmer further advised that property owners have experienced <br />thefts and it is hoped that closing the alley will deter further <br />thefts. <br />Mrs. Gertrude Botka, also a Petitioner, 514 Kosciuszko Street, <br />South Bend, Indiana, was present and stated that she has no <br />objections to the vacation of this alley. <br />In response to Mrs. Botka's questions, Mr. Vance advised that the <br />portion of the vacated alley abutting her property will revert to <br />her and in order to find out how much additional tax will be <br />assessed, she should check with the Portage Township Assessor's <br />Office. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, the Public Hearing on this <br />matter was closed. <br />Mr. Leszczynski advised that favorable comments have been <br />received from the Engineering Department, Area Plan Commission <br />and the Department of Community Development concerning this <br />proposed alley vacation. <br />Therefore, upon a motion made by Mrs. DeClercq, seconded by Mr. <br />Vance and carried, the Clerk was instructed to forward to the <br />Common Council a favorable recommendation on the above referred <br />to alley vacation subject to any and all utility easements. <br />OPENING AND AWARD OF BIDS - SALE OF ABANDONED VEHICLES <br />This was the date set for the receiving and opening of sealed <br />bids for the sale of approximately ten (10) abandoned vehicles <br />which have been stored at Steve and Gene's Auto & Truck Salvage <br />and Repair, 3109 South Gertrude Street, South Bend, Indiana. The <br />Clerk tendered proofs of publication of Notice in the South Bend <br />Tribune and the Tri-County News which were found to be <br />sufficient.
