132 <br />REGULAR MEETING MAY 5, 1987 <br />ACCEPT AND APPROVE IRREVOCABLE LETTER OF CREDIT NO. 458 - JACK <br />HICKEY ASSOCIATES, INC. <br />Ms. Lori A. Baker, Credit Administrator, Valley American Bank, <br />P.O. Box 328, South Bend, Indiana, advised that the bank opens <br />Irrevocable Letter of Credit No. 458 in favor of the City up to <br />an aggregate amount of $100,000.00 for the account of Jack Hickey <br />Associates, Inc. <br />Ms. Baker stated that this Letter of Credit is to warrant the <br />guarantee and completion and construction of curbs, street, water <br />sewers, storm sewers, sidewalks and street lighting in Section V, <br />Kensington Farms East. <br />Upon a motion <br />and carried, <br />approved. <br />APPROVE I <br />made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />the Letter of Credit as submitted was accepted and <br />FICATION AND HOLD HARMLESS AGRE <br />118 NOR <br />MAIN STREET) <br />An Indemnification and Hold Harmless Agreement between the City <br />and Martin E. and Carol P. Feferman, owners of the real estate <br />commonly known as 118 North Main Street was submitted to the <br />Board for approval. <br />Mr. Leszczynski advised that the City wishes to use said property <br />on June 13, 1987 in conjunction with the World's Largest Garage <br />Sale to be conducted at the parking garage. It was noted that <br />Mr. and Mrs. Feferman are willing to allow the use of the lot but <br />wish to protect themselves from any lawsuit or damages resulting <br />from injuries to third parties. Therefore, this Indemnification <br />Agreement is being submitted for Board approval and signature. <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, the Agreement as submitted was approved and <br />executed. <br />APPROVE REQUEST TO ADVERTISE FOR RECEIPT OF BIDS - SALE OF <br />ABANDONED VEHICLES <br />Mrs. Patricia E. DeClercq, Director, Department of Code <br />Enforcement, requested permission to advertise for the sale of <br />approximately ten (10) abandoned vehicles, which are being stored <br />at Steve & Gene's Auto & Truck Salvage and Repair, 3109 South <br />Gertrude Street, South Bend, Indiana. It was noted that all <br />vehicles have been stored more than fifteen (15) days, <br />identification checks had been run for auto theft and the owners <br />and lienholders notified. Upon a motion made by Mrs. DeClercq, <br />seconded by Mr. Leszczynski and carried, the above request was <br />approved and a date of May 19, 1987, was established for the <br />receiving and opening of sealed bids. <br />APPROVE REQUEST OF ST. JOE WATERCOLOR SOCIETY FOR ONE-WAY <br />DESIGNATION OF STREETS IN CONJUNCTION WITH ART FAIR - JUNE 20-21 <br />1987 <br />Mr. Leszczynski advised that the Bureau of Traffic and Lighting <br />and the Police Department Traffic Division have reviewed the <br />above referred to request submitted to the Board on April 14, <br />1987, and recommend approval. Upon a motion made by Mrs. <br />DeClercq, seconded by Mr. Leszczynski and carried, the <br />recommendation was accepted and the request approved. <br />APPROVE REQUEST OF ST. JOSEPH COUNTY MEMORIAL SOCIETY FOR STREET <br />CLOSURE IN CONJUNCTION WITH MEMORIAL DAY ACTIVITIES - MAY 25 <br />1987 <br />The Bureau of Traffic and Lighting and the Police Department <br />Traffic Division have reviewed the above referred to request <br />submitted to the Board on April 28, 1987 and recommend approval. <br />1 <br />1 <br />1 <br />
