R��JJ <br />REGULAR MEETING <br />APRIL 25, 1988 <br />APPROVE STREET RIGHT-OF-WAY LAND USE AGREEMENT - ALLIED <br />CORPORATION <br />Mr. Leszczynski advised that Mr. Michael J. Stepanek, Jr., <br />Counsel, on behalf of Allied Corporation, 401 North Bendix Drive, <br />South Bend, Indiana, submitted to the Board a City Street <br />Right -of -Way Land Use Agreement which grants to Allied permission <br />to install monitor wells in the public right-of-way. Mr. <br />Leszczynski stated that the installation of the wells will not <br />effect traffic. <br />The Agreement, between the City and Allied-Signal, Inc.,through <br />the Bendix Engine Controls Division, formerly the Bendix Energy <br />Controls Division and the Bendix Wheels and Brakes Division, <br />formerly the Bendix Aircraft Brake & Strut Division of its <br />Allied-Signal Aerospace Company and through its Bendix Automotive <br />Brake Systems - North America, formerly the Bendix Chassis & <br />Brake Components Division indicates that Allied-Signal has <br />groundwater contamination beneath its premises along Bendix Drive <br />in South Bend and has implemented a recovery well program to <br />recover the groundwater contamination and retard/eliminate the <br />movement of the groundwater contamination from the Allied-Signal <br />premises. Allied desires to expand its recovery well program by <br />installing up to twenty-five (25) recovery wells on the northern <br />boundary of the premises south of Bendix Drive and Bertrand <br />Street east and west of the intersection of Bendix Drive and <br />Bertrand Street. As Allied is unable to place the recovery wells <br />on its property south of Bendix Drive and Bertrand Street due to <br />the presence of buildings and underground utilities, Allied <br />desires to place the recovery wells beneath the sidewalk within <br />the City's right-of-way for Bendix Drive and Bertrand Street. <br />Therefore, upon a motion made by Mr. Leszczynski, seconded by <br />Mrs. DeClercq, and carried, the Agreement as submitted was <br />approved and executed. <br />ADOPT RESOLUTION NO. 12-1988 - RENOUNCIATION OF DEED <br />Mr. Leszczynski advised that in 1985, Ms. Anna Marie Kiskowski, <br />in order to avoid taxes and clean-up charges, deeded to the City <br />a parcel of property located in the 1200 block of Fremont without <br />the City's knowledge. Resolution No. 12-1988 submitted to the <br />Board today for adoption returns this property to her. There- <br />fore, upon a motion made by Mr. Leszczynski, seconded by Mrs. <br />DeClercq and carried, the following Resolution No. 12-1988 was <br />adopted: <br />CITY OF SOUTH BEND, INDIANA <br />BOARD OF PUBLIC WORKS <br />RESOLUTION NO. 12-1988 <br />WHEREAS, one Anna Marie Johnson, a/k/a Anna Marie Kiskowski, <br />was the apparent owner of record on September 20, 1985, of the <br />following described real property located in South Bend, Indiana: <br />North One Half of Lot Numbered Sixty-three (63) <br />as shown on the recorded Plat of Olive Heights <br />Addition to the City of South Bend; and <br />WHEREAS, on November 18, 1987, Anna Marie Johnson or some- <br />one acting on her behalf recorded a Quit -Claim Deed to said <br />property to the City of South Bend in the St. Joseph County <br />Recorder's Office; and <br />WHEREAS, said recording was done without the knowledge of <br />any officer, agent or employee of the City of South Bend, much <br />less at the request of any such officer, agent or employee; and <br />1 <br />1 <br />
