REGULAR MEETING APRIL 25, 1988 <br />The Clerk tendered proofs of publication of Notice in the South <br />Bend Tribune and the Tri-County News which were found to be <br />sufficient. The following one (1) Proposal was publicly opened <br />and read: <br />FEDERATED COLLECTION AGENCY <br />2015 West Western Avenue, 1138 <br />South Bend, Indiana <br />The Proposal, signed by Robert Forgash, indicates that <br />Federated shall retain forty per cent (40%) of all money <br />recovered toward satisfaction of accounts as compensation <br />for Federated's services. Fees will not be assessed on <br />unrecovered funds. Further, the maximum amount which <br />Federated shall be allowed to collect in any calendar year, <br />from past due accounts presented to it by the City shall be <br />ten thousand dollars ($10,000.00). <br />Ms. Katherine Humphreys, Director, Administration and Finance, in <br />response to a question from the news media, advised that the <br />City's collection rate is sixty-five per cent (65%). <br />Upon a motion made by Mr. Leszczynski, seconded by Ms. Humphreys <br />and carried, the Proposal as submitted was referred to the Fire <br />Department and City Controller for review and recommendation. <br />APPROVE UTILITY AGREEMENTS - EDISON ROAD WIDENING PROJECT <br />Mr. Leszczynski advised that Utility Agreements, the normal <br />Agreements for Federal Aid projects, with the City of South Bend <br />Water Works, Heritage Cablevision Corporation, Indiana Bell <br />Telephone Company, Indiana Michigan Power Company, Northern <br />Indiana Public Service Company and City of South Bend Bureau of <br />Sewers have been submitted for approval in conjunction with the <br />widening of Edison Road between Crestwood Boulevard and Hickory <br />Road. <br />The Agreements indicate that utility facilities located on Edison <br />Road from four hundred (400) feet east of Crestwood Boulevard to <br />Hickory Road are hereby granted permission to be located within <br />the highway right-of-way in accordance with drawings submitted <br />and will be placed adjacent to the present utility facilities and <br />within two (2) feet of the right-of-way line as indicated on the <br />plans for the proposed project. <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, the above referred to Agreements were approved and <br />executed. <br />APPROVE SUBORDINATED_ SECURITY AGREEMENT - AE PISTONS, INC. <br />Ms. Beth Leonard, Office of Community Development, advised that <br />the Subordinated Security Agreement submitted today is in <br />conjunction with the Loan Agreement previously approved and is <br />securing some equipment that AE Pistons, Inc., has at their <br />building. The Subordinated Security Agreement indicates that AE <br />Pistons, Inc., grants to the City of South Bend a security <br />interest in all equipment and machinery now owned by AE Pistons <br />to secure payment and performance of obligations. In response to <br />questions from Mr. Dick Maginout, WSBT-TV, Ms. Leonard further <br />clarified that the loan previously approved is for a period of <br />two (2) years and is in the amount of $100,000.00 which was made <br />possible through a state grant. She further stated that AE <br />Pistons is located in the Toll Road Industrial Park and that the <br />City has worked with the County in this endeavor. <br />Therefore, upon a motion made by Mrs. DeClercq, seconded by Ms. <br />Humphreys and carried, the Subordinated Security Agreement as <br />submitted was approved and executed. <br />
