e <br />REGULAR MEETING <br />OCTOBER 2, 1989 <br />Development will continue to represent the City in this matter by <br />filing with the Common Council the appropriate Petition to <br />Vacate. <br />Therefore, Mrs. DeClercq made a motion that the Resolution as <br />submitted in regards to this matter be adopted. Ms. Humphreys <br />seconded the motion which carried, and the following Resolution <br />No. 39-1989 was adopted: <br />RESOLUTION NO. 39-1989 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />AUTHORIZING THE DEPARTMENT OF ECONOMIC DEVELOPMENT <br />FOR THE CITY OF SOUTH BEND TO PETITION <br />THE SOUTH BEND COMMON COUNCIL FOR THE VACATION OF <br />REDEDICATED PUBLIC RIGHTS -OF -WAY EXISTING OVER <br />AND UPON THE MAPLE LANE SCHOOL PROPERTY <br />STATEMENT OF PURPOSE AND INTENT <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, <br />acting by and through its Board of Public Works, acquired from <br />the South Bend Community School Corporation on March 20, 1989, <br />title to what is commonly referred to as the Maple Lane School <br />property, the exact legal description of which appears in the <br />Quit -Claim Deed transferring such title, a true and complete copy <br />of which is attached hereto., marked as Exhibit "A," and is <br />incorporated herein; and <br />WHEREAS, certain portions of said Maple Lane School property <br />were dedicated to the public for use as public highways, by the <br />Deed of Dedication executed on August 24, 1945 by Cortland and <br />Florence DuComb, said portions being more particularly described <br />as follows: <br />PARCEL NO. 1. Beginning at the North <br />West Corner of the South One-half (1/2) <br />of the South west Quarter (1/4) of <br />Section Thirty-two (32), Township <br />Thirty-eight (38) North, Range Three (3) <br />East, thence East 1072 feet more or less <br />to a point Thirty (30) feet due South of <br />the North-East corner of Rose Street and <br />Northern Avenue as platted in the <br />recorded Addition of Maple Lane; then <br />South Thirty (30) feet; thence West 1072 <br />feet more or less to a point Thirty (30) <br />feet South of the place of beginning; <br />thence North to the place of beginning. <br />PARCEL NO. 2. Beginning at a point <br />Thirty (30) feet South of the South West <br />corner of Lot Numbered Two Hundred <br />Fifty-six (256) Maple Lane Addition. <br />Lot is located at the North East corner <br />of Maple Lane and Rose Street; thence <br />South 661 feet; thence West Fifty (50) <br />feet; thence North 661 feet, thence East <br />Fifty (50) feet to place of beginning. <br />11 <br />1 <br />
