295 <br />REGULAR MEETING <br />OCTOBER 2, 1989 <br />2nd East/West alley north of Marion Street, running <br />West from Leland Street for a distance of approximately <br />160.3 feet <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. David Fritz, 618 <br />North Leland Avenue, South Bend, Indiana, as Contact Person on <br />behalf of the following Petitioners: <br />David E. Fritz 618 North Leland South Bend, IN <br />Vicki J. Fritz 618 North Leland South Bend, IN <br />Carolyn J. Clements 2266 W. Markle Rd. Huntington, IN <br />It was further noted that pursuant to South Bend Municipal Code <br />Section 18-53.8, owners of property within fifty feet (501) of <br />the alley to be vacated as well as property owners whose property <br />abut the proposed alley to be vacated were notified of the <br />Board's Public Hearing date. <br />Mr. David Fritz, 618 North Leland Street, South Bend, Indiana, <br />Contact Person and Petitioner, was present and advised the Board <br />that the purpose of this vacation is to provide for the safety <br />and welfare of the children and residents in the area. <br />Mr. Fritz informed the Board that he owns two (2) lots north of <br />the alley to be vacated and has conferred with residents on the <br />south side of the alley regarding this proposed vacation. Based <br />on those discussions it was determined that it would be <br />beneficial for the residents to have the alley closed. Mr. Fritz <br />further noted that motorists utilize the alley as an extension of <br />Navarre Street and drive very fast through the alley. Also, <br />because of the location of a structure close to the alley, cars <br />are blinded and their line of vision is obstructed until they <br />come within fifteen feet (151) of the sidewalk. This type of <br />situation is very dangerous to individuals utilizing the area. <br />Also, Mr. Fritz stated that because of a curb cut at that alley, <br />individuals veer north onto his property thereby prohibiting him <br />from doing any planting in that area to enhance his property. <br />In conclusion, Mr. Fritz informed the Board that in discussions <br />with his neighbors regarding this vacation, he found no one <br />opposed to the closing of the alley. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Mrs. DeClercq and carried, the Public <br />Hearing on this matter was closed. <br />Further, upon a motion made by Mrs. DeClercq, seconded by Ms. <br />Humphreys and carried, the Clerk was instructed to forward to the <br />Common Council a favorable recommendation on the above referred <br />to alley vacation subject to any and all utility easements. <br />ADOPT RESOLUTION NO. 39-1989 - AUTHORIZING THE DEPARTMENT OF <br />ECONOMIC DEVELOPMENT FOR THE CITY OF SOUTH BEND TO PETITION FOR <br />THE VACATION OF DEDICATED PUBLIC RIGHTS -OF -WAY EXISTING OVER AND <br />UPON THE MAPLE LANE SCHOOL PROPERTY <br />Mr. David Roos, Department of Economic Development, was present <br />and advised the Board that the Department of Economic Development <br />has been representing the City in the acquisition of the Maple <br />Lane School property which will be rehabilitated for use by the <br />Army Reserve Center. In trying to address title issues, it <br />became evident that some streets were dedicated to the public but <br />were never constructed which are located on the school property <br />site. The proposed vacation of these public rights -of -way is a <br />remedy for this title issue and the Department of Economic <br />
