Walsh, President, Non - <br />Collusion Affidavit was in order and a 5% Bid Bond <br />was submitted. <br />BID: $228,949.50 <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, the above bids were referred to the Engineering <br />Department and the Department of Economic Development for review <br />and recommendation and the Applications for Bidder Qualification <br />were accepted for filing and referred to the Affirmative Action <br />Review Committee for review and recommendation. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - WESTERN AVENUE FROM <br />NOTRE DAME TO FRANCES STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed street vacation described as <br />follows: <br />Division (now Western) Avenue 20 feet public right- <br />of-way between Frances Street and Notre Dame Avenue <br />all being in Becks 1st <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. Bruce A. <br />Zakrzewski, Controller, TRANSPO, 901 East Northside Boulevard, <br />South Bend, Indiana, on behalf of the Petitioner, Mr. Richard L. <br />Rohde, General Manager, South Bend Public Transportation <br />Corporation, 901 East Northside Boulevard, South Bend, Indiana. <br />It was further noted that pursuant to South Bend Municipal Code <br />Section 18-53.8, property owners within fifty feet (501) of the <br />street to be vacated as well as those property owners abutting <br />the street to be vacated were notified of the Board's Public <br />Hearing date. <br />Mr. Richard L. Rohde, General Manager, South Bend Public <br />Transportation Corporation, 901 East Northside Boulevard, South <br />Bend, Indiana, was present and advised the Board that the purpose <br />of this vacation is to improve the safety and security around the <br />South Bend Public Transportation Corporation's bus garage. Mr. <br />Rohde stated that it is the intent of the Corporation to erect a <br />fence around the area of the garage in order to enhance the <br />safety and security of the area. <br />There being no one else present wishing to speak either for or <br />against the proposed street vacation, and no written objections <br />having been filed with the Board, Ms. Humphreys made a motion <br />that the Public Hearing regarding this proposed vacation be <br />closed. Mrs. DeClercq seconded the motion which carried. <br />Further; Ms. Humphreys made a motion that the Clerk be instructed <br />to forward to the Common Council a favorable recommendation on <br />the above referred to street vacation subject to any and all <br />utility easements. Mrs. DeClercq seconded the motion which <br />carried. Board President John Leszczynski abstained from voting <br />on this matter. <br />PUBLIC HEARING <br />AND FAVORABLE <br />E/W ALLEY N.
