REGULAR MEETING JULY 24, 1989 215 WHEREAS, one (1) of those sixty-seven (67) vehicles declared obsolete was a 1980 Blue Ford Fairmont carrying vehicle identification number: OX92B139929; and WHEREAS, as the result of oversight, this 1980 Blue Ford Fairmont was removed from the group of sixty-seven (67) obsolete vehicles and replaced with another obsolete City -owned vehicle, to -wit: a 1979 Ford, carrying vehicle identification number: 9X92Y110790; and WHEREAS, as the result of oversight, the certificate of title to the 1980 Blue Ford Fairmont was not replaced by the certificate of title for the substituted 1979 Ford; and WHEREAS, the bid Mr. William Jenkins for J&B Auto Sales, was accepted as the highest and best bid on the 1979 Ford; and WHEREAS, as the result of the failure to substitute the certificate of title for the 1979 Ford with that of the 1980 Blue Ford Fairmont, the certificate of title to the 1980 Blue Ford Fairmont was transferred, in error, to J&B Auto Sales; and WHEREAS, Mr. Jenkins subsequently transferred the 1979 Ford, along with the certificate of title to the 1980 Blue Ford Fairmont, to Ms. Teresa Graves, who recently identified the error and brought the same to the attention of the Board; and WHEREAS, Ms. Graves cannot transfer the title to the 1979 Ford until title to the same is properly transferred to her; and WHEREAS, the City of South Bend currently has possession of the 1980 Blue Ford Fairmont, the title to which it desires to receive back from Ms. Graves, and has title to the 1979 Ford which Ms. Graves desires to receive from the City; NOW THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend as follows: 1. That photocopies of the titles to the 1980 Blue Ford Fairmont, carrying vehicle identification number: OX92B139929, and to the 1979 Ford carrying vehicle number: 9X92Y110790 be made by the Clerk of the Board. 2. That the Clerk transfer proper title to the 1979 Ford carrying vehicle identification number 9X92Y110790 to Ms. Teresa Grays upon receipt from her of the proper title to the 1980 Blue Ford Fairmont carrying vehicle identification number: OX92B139929. 3. That the Clerk of the Board file with the local license branch office said photocopies, said corrected titles, police department vehicle checks for both the 1979 Ford and the 1980 Blue Ford Fairmont, a copy of this resolution, and the attached affidavit of the Clerk, a true and complete copy of the same being incorporated herein.
