76 <br />REGULAR MEETING <br />MARCH 20, 1989 <br />South Bend, Indiana. It was further noted that pursuant to <br />South Bend Municipal Code Section 18-53.8, owners whose property <br />abut the proposed street to be vacated as well as those within <br />fifty (50) feet of the proposed vacation were notified of the <br />Board's Public Hearing date. <br />Mr. Rick Pitts, Department of Economic Development, was present <br />and advised the Board that the purpose of the vacation is to <br />construct a "greenhouse" type seating area for the adjacent <br />Edwardo's Restaurant. Mr. Pitts stated that this is an important <br />project which will bring activity along and off of Michigan <br />Street. The vacation is to provide some additional space for the <br />greenhouse coming off of the building where the Edwardo's <br />Restaurant will be going in and is very much in alignment with <br />plans that the Department of Economic Development has had for <br />some years. Mr. Pitts stated that this is a very well thought <br />out project, that there is sufficient space remaining on the <br />sidewalk for pedestrian traffic and the Department of Economic <br />Development is in support of the vacation. <br />Mr. Leszczynski advised that the ordinance submitted with the <br />Petition to the Common Council should contain language should the <br />restaurant fail to utilize the space for a greenhouse type <br />seating. <br />Mr. Larry Koepfle, Department of Economic Development, advised <br />Mr. Leszczynski that a substitute ordinance will be submitted to <br />the Common Council which contains a Section V which states that <br />in the event that the vacated property ceases to be used as a <br />"greenhouse" seating area for an adjacent restaurant, this <br />vacation shall be void and the property shall revert to public <br />right-of-way status. <br />There being no one else present wishing to speak either for or <br />against the proposed street vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Mrs. DeClercq and carried, the Public <br />Hearing on this matter was closed. <br />It was noted that favorable comments have been received from the <br />Area Plan Commission and the Department of Economic Development <br />concerning this proposed street vacation. <br />Therefore, upon a motion made by Mrs. DeClercq, seconded by Mr. <br />Leszczynski and carried, the Clerk was instructed to forward to <br />the Common Council a favorable recommendation on the above <br />referred to street vacation subject to any and all utility <br />easements. <br />APPROVE COMMUNITY DEVELOPMENT ADDENDA <br />The following Community Development Addenda were presented to the <br />Board for approval: <br />ADDENDUM II <br />HOUSING DEVELOPMENT CORPORATION <br />HOUSING REHABILITATION FUND ACTIVITY <br />Addendum II adds $12,920.00 to this activity which is <br />targeted to the West Washington/Chapin Street area. <br />ADDENDUM II <br />WEST WASHINGTON/CHAPIN BUSINESS ASSISTANCE <br />Addendum II releases an additional $37,000.00 to South Bend <br />Heritage and extends the time of the contract. <br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys <br />and carried, the above referred to Addenda were approved and <br />executed. <br />1 <br />1 <br />
