76
REGULAR MEETING
MARCH 20, 1989
South Bend, Indiana. It was further noted that pursuant to
South Bend Municipal Code Section 18-53.8, owners whose property
abut the proposed street to be vacated as well as those within
fifty (50) feet of the proposed vacation were notified of the
Board's Public Hearing date.
Mr. Rick Pitts, Department of Economic Development, was present
and advised the Board that the purpose of the vacation is to
construct a "greenhouse" type seating area for the adjacent
Edwardo's Restaurant. Mr. Pitts stated that this is an important
project which will bring activity along and off of Michigan
Street. The vacation is to provide some additional space for the
greenhouse coming off of the building where the Edwardo's
Restaurant will be going in and is very much in alignment with
plans that the Department of Economic Development has had for
some years. Mr. Pitts stated that this is a very well thought
out project, that there is sufficient space remaining on the
sidewalk for pedestrian traffic and the Department of Economic
Development is in support of the vacation.
Mr. Leszczynski advised that the ordinance submitted with the
Petition to the Common Council should contain language should the
restaurant fail to utilize the space for a greenhouse type
seating.
Mr. Larry Koepfle, Department of Economic Development, advised
Mr. Leszczynski that a substitute ordinance will be submitted to
the Common Council which contains a Section V which states that
in the event that the vacated property ceases to be used as a
"greenhouse" seating area for an adjacent restaurant, this
vacation shall be void and the property shall revert to public
right-of-way status.
There being no one else present wishing to speak either for or
against the proposed street vacation, and no written objections
having been filed with the Board, upon a motion made by Mr.
Leszczynski, seconded by Mrs. DeClercq and carried, the Public
Hearing on this matter was closed.
It was noted that favorable comments have been received from the
Area Plan Commission and the Department of Economic Development
concerning this proposed street vacation.
Therefore, upon a motion made by Mrs. DeClercq, seconded by Mr.
Leszczynski and carried, the Clerk was instructed to forward to
the Common Council a favorable recommendation on the above
referred to street vacation subject to any and all utility
easements.
APPROVE COMMUNITY DEVELOPMENT ADDENDA
The following Community Development Addenda were presented to the
Board for approval:
ADDENDUM II
HOUSING DEVELOPMENT CORPORATION
HOUSING REHABILITATION FUND ACTIVITY
Addendum II adds $12,920.00 to this activity which is
targeted to the West Washington/Chapin Street area.
ADDENDUM II
WEST WASHINGTON/CHAPIN BUSINESS ASSISTANCE
Addendum II releases an additional $37,000.00 to South Bend
Heritage and extends the time of the contract.
Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys
and carried, the above referred to Addenda were approved and
executed.
1
1
