(5 <br />REGULAR MEETING MARCH 20. 1989 <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - STREET VACATION: <br />WASHINGTON STREET WEST OF NILES AVENUE EXTENDED AND EAST OF THE <br />EAST RACE <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed street vacation described as <br />follows: <br />That portion of Washington Street west of Niles Avenue <br />described as follows: Beginning at the southeast corner <br />of Lot 48 of the original Town of Lowell thence west <br />along the south line of said Lot 48 which is also the <br />north right-of-way line of Washington Street a distance <br />of 132 feet to a point; thence southeasterly to a point <br />on the south right-of-way line of Washington Street <br />which point is 70 feet west of the west right-of-way line <br />of. Niles Avenue; thence east 70 feet along said south <br />right-of-way line of Washington Street to the west right- <br />of-way line of Niles Avenue; thence north 82.5 feet more <br />or less along the west right-of-way line of Niles Avenue <br />extended to the place of beginning, containing approximately <br />8,332 square feet. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by the City of South Bend <br />Board of Public Works, 1308 County -City Building, South Bend, <br />Indiana. It was further noted that pursuant to South Bend <br />Municipal Code Section 18-53.8, owners whose property abut the <br />proposed street to be vacated as well as those within fifty (50) <br />feet of the proposed vacation were notified of the Board's Public <br />Hearing date. <br />There being no one present wishing to speak either for or against <br />the proposed street vacation, and no written objections having <br />been filed with the Board, upon a motion made by Mr. Leszczynski, <br />seconded by Ms. Humphreys and carried, the Public Hearing on this <br />matter was closed. <br />Mr. Leszczynski advised that favorable comments have been <br />received from the Engineering Department, Area Plan Commission <br />and the Department of Economic Development concerning this <br />proposed street vacation. <br />Therefore, upon a motion made by Ms. Humphreys, seconded by Mrs. <br />DeClercq and carried, the Clerk was instructed to forward to the <br />Common Council a favorable recommendation on the above referred <br />to street vacation subject to any and all utility easements. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - STREET VACATION: <br />PORTION OF WEST WAYNE STREET RIGHT-OF-WAY FROM LOT #288 OF THE <br />ORIGINAL PLAT OF SOUTH BEND <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on the following proposed street vacation <br />which is a certain portion of right-of-way that will be utilized <br />for development in conjunction with Edwardo's Restaurant: <br />The North 11.00 feet of West Wayne Street right-of-way <br />that is abutting the East 73.00 feet of Lot #288 of <br />the Original Plat of South Bend excepting therefrom <br />a rectangular portion 6.02 feet North -South by 14.00 <br />feet East-West at the Southeast corner of said 11.00 <br />feet strip. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. Rick Pitts, <br />Department of Economic Development, 1200 County -City Building, <br />
