(5 REGULAR MEETING MARCH 20. 1989 PUBLIC HEARING AND FAVORABLE RECOMMENDATION - STREET VACATION: WASHINGTON STREET WEST OF NILES AVENUE EXTENDED AND EAST OF THE EAST RACE Mr. Leszczynski advised that this was the date set for the Board's Public Hearing on a proposed street vacation described as follows: That portion of Washington Street west of Niles Avenue described as follows: Beginning at the southeast corner of Lot 48 of the original Town of Lowell thence west along the south line of said Lot 48 which is also the north right-of-way line of Washington Street a distance of 132 feet to a point; thence southeasterly to a point on the south right-of-way line of Washington Street which point is 70 feet west of the west right-of-way line of. Niles Avenue; thence east 70 feet along said south right-of-way line of Washington Street to the west right- of-way line of Niles Avenue; thence north 82.5 feet more or less along the west right-of-way line of Niles Avenue extended to the place of beginning, containing approximately 8,332 square feet. It was noted that this Public Hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petition filed by the City of South Bend Board of Public Works, 1308 County -City Building, South Bend, Indiana. It was further noted that pursuant to South Bend Municipal Code Section 18-53.8, owners whose property abut the proposed street to be vacated as well as those within fifty (50) feet of the proposed vacation were notified of the Board's Public Hearing date. There being no one present wishing to speak either for or against the proposed street vacation, and no written objections having been filed with the Board, upon a motion made by Mr. Leszczynski, seconded by Ms. Humphreys and carried, the Public Hearing on this matter was closed. Mr. Leszczynski advised that favorable comments have been received from the Engineering Department, Area Plan Commission and the Department of Economic Development concerning this proposed street vacation. Therefore, upon a motion made by Ms. Humphreys, seconded by Mrs. DeClercq and carried, the Clerk was instructed to forward to the Common Council a favorable recommendation on the above referred to street vacation subject to any and all utility easements. PUBLIC HEARING AND FAVORABLE RECOMMENDATION - STREET VACATION: PORTION OF WEST WAYNE STREET RIGHT-OF-WAY FROM LOT #288 OF THE ORIGINAL PLAT OF SOUTH BEND Mr. Leszczynski advised that this was the date set for the Board's Public Hearing on the following proposed street vacation which is a certain portion of right-of-way that will be utilized for development in conjunction with Edwardo's Restaurant: The North 11.00 feet of West Wayne Street right-of-way that is abutting the East 73.00 feet of Lot #288 of the Original Plat of South Bend excepting therefrom a rectangular portion 6.02 feet North -South by 14.00 feet East-West at the Southeast corner of said 11.00 feet strip. It was noted that this Public Hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petition filed by Mr. Rick Pitts, Department of Economic Development, 1200 County -City Building,
