328 <br />REGULAR MEETING <br />OCTOBER 8, 1990 <br />- OF CITY AWNING TO INSTALL A CANOPY AT 720 EAST JEFFERSON <br />BOULEVARD - BELMONT BEVERAGES <br />Mr. Al Newman, Sales Representative, City Awning of South Bend, <br />1835 South Franklin Street, South Bend, Indiana, requested <br />permission to install a canopy at Belmont Beverages, 720 East <br />Jefferson Boulevard. Mr. Newman noted that the canopy will be <br />installed at a minimum of eight feet (81) six inches (611) from <br />the sidewalk level to the bottom of the canopy. Submitted with <br />the request was a drawing indicating the canopy dimensions and <br />details. <br />- FOR DESIGNATED HANDICAPPED PARKING SPACE AT 524 LA PORTE AVENUE <br />Ms. Nannie Green, 524 LaPorte Avenue, South Bend, Indiana, <br />requested that the parking space in front of her residence be <br />designated as a handicapped parking space. <br />- OF QUEEN ANNE INN FOR HANDICAPPED PARKING SPACE <br />Mr. Robert D. Medhurst, Innkeeper, Queen Anne Inn, 420 West <br />Washington Street, South Bend, Indiana, requested that a <br />handicapped parking space be designated in front of the Inn. <br />Mr. Leszczynski made a motion that the above referred to requests <br />be referred to the appropriate City departments and bureaus for <br />review and recommendation. Mrs. DeClercq seconded the motion <br />which carried. <br />APPROVE SOUTH BEND WATER WORKS RULES AND REGULATIONS <br />Mr. Joseph Agostino, Director, Water Works, was present and <br />advised the Board that submitted today for approval and execution <br />were the South Bend Water Works Rules and Regulations. Mr. <br />Agostino stated that these rules and regulations have not been <br />updated for several years and some problems were experienced over <br />the years. Mr. Agostino stated that with the help of Chief <br />Assistant City Attorney Jenny Pitts Manier the updating of the <br />Rules and Regulations has been completed. <br />Mr. Agostino stated that in the new rules, landlords will be <br />responsible for all billings to the property. The landlord has <br />to make application for himself or jointly with the tenant. This <br />procedure will reduce delinquencies and paperwork and also liens <br />can then be filed against landlords. Mr. Agostino stated that <br />another change is in the credits and adjustments for faulty <br />meters. In conclusion, Mr. Agostino stated that the rules and <br />regulations are in compliance with the Indiana Utility <br />Regulatory Commission. Upon a motion made by Ms. Humphreys, <br />seconded by Mrs. DeClercq and carried, the Rules and Regulations <br />as submitted were approved. <br />APPROVE AGREEMENTS FOR USE OF CITY -OWNED PROPERTY - N.E. CORNER <br />OF CHAPIN & WESTERN AVENUE <br />Mr. Leszczynski advised that submitted to the Board was an <br />Agreement for Use of City Owned Property between Charles Green <br />and the City of South Bend. <br />The Agreement indicates that the City, as owner of the real <br />property located at the northeast corner of Chapin Street and <br />Western Avenue, has control of and is responsible for maintaining <br />all property owned by the City including this particular lot. <br />Further, on September 4, 1990, the Board adopted Resolution <br />20-1990 prohibiting trespassing by persons and/or vehicles upon <br />this particular parcel of property. <br />Mr. Charles Green, owner of a business establishment known as the <br />Red Carpet Lounge, 317 Chapin Street has insufficient off-street <br />parking and for which establishment the available on -street <br />parking is inadequate.
