241 <br />REGULAR MEETING AUGUST 13, 1990 <br />Frances Street, South Bend, Indiana, indicating that the Contract <br />amount for the above referred to project be decreased by <br />$3,813.00 for a new Contract sum including this Change Order in <br />the amount of $284,747.00. It is noted that this decrease is for <br />the deletion of a metal canopy in one of the restrooms. Upon a <br />motion made by Ms. Humphreys, seconded by Mrs. DeClercq and <br />carried, Change Order No. 2 was approved and executed. <br />APPROVE PROJECT COMPLETION AFFIDAVIT - 27TH STREET LIFT STATION <br />IMPROVEMENTS PROJECT <br />Mr. Leszczynski advised that Kaser-Spraker Construction, Inc., <br />has submitted the Project Completion Affidavit for the above <br />referred to project indicating a final cost of $122,766.00. Upon <br />a motion made by Mr. Leszczynski, seconded by Ms. Humphreys and <br />carried, the Project Completion Affidavit was approved and the <br />appropriate three-year Maintenance Bond as submitted was accepted <br />for filing. <br />APPROVE RECOMMENDATION TO REVIEW BIDS - DIESEL FUEL ##1 AND #2 <br />Board Attorney Jenny Pitts Manier advised that the specifications <br />for fuel oil as well as the City's contract with Petroleum <br />Traders, 1122 Thomas Road, Fort Wayne, Indiana, the supplier of <br />diesel fuel #1 and #2, require that the City monitor and <br />determine whether the bid remains competitive. Mrs. Manier <br />explained that this bid has been monitored and it has been <br />determined that the bid of Petroleum Traders for diesel fuel #1 <br />and #2 has not been competitive with prices the City could have <br />received. <br />Therefore, Mrs. Manier recommended that the Clerk of the Board be <br />instructed to contact the vendors originally submitting bids to <br />the City in January for transport diesel fuel oil purchases for <br />calendar year 1990, to determine whether their offers remain in <br />effect and directing such vendors to respond to the Board, in <br />writing, by August 20, 1990. At that time the Board should <br />determine whether it can award a bid or will need to readvertise <br />for the receipt of bids for transport diesel fuel requirements. <br />Mrs. Manier recommended that should the Board act favorably upon <br />Mr. Phil St. Clair recommendation to rescind the bid of <br />Petroleum Traders, that bid should be rescinded with an effective <br />date of one (1) week after award of a new bid whether it is one <br />(1) week after next Monday or after rebidding. Mrs. DeClercq <br />made a motion that the recommendation of Board Attorney Jenny <br />Pitts Manier be accepted and approved. Ms. Humphreys seconded <br />the motion which carried. <br />FILING OF AMENDMENT - NOTICE TO OWNER OF CLAIM - ST. JOSEPH/WAYNE <br />STREET PARKING GARAGE PEDESTRIAN WALKWAY PROJECT <br />Board Attorney Jenny Pitts Manier reminded the Board that on July <br />23, 1990, the Board accepted for filing a Subcontractor's <br />Verified Statement of Claim as received from Shaffner Heaney <br />Associates, Inc., in the amount of $11,237.00 which indicated <br />that Shaffner has not been paid for two (2) skylights it provided <br />to a subcontractor of Murdock Construction Company, general <br />contractor on the above referred to project. Mrs. Manier advised <br />that submitted today is a letter from Shaffner Heaney indicating <br />that a portion of its $11,237.00 claim for materials provided to <br />Murdock & Sons has been paid. Therefore, the record should <br />reflect that the proper amount of the claim at this time is <br />$1,410.00. Mr. Leszczynski made a motion that the notification <br />of reduced amount of Notice to Owner of Claim be accepted and <br />filed. Ms. Humphreys seconded the motion which carried. <br />APPROVE CONTRACTS FOR SERVICES - CAR WASHES FOR CITY VEHICLES <br />Mr. Leszczynski advised that pursuant to the Board's award of <br />bids for car washes for City vehicles on July 30, 1990, to <br />Hi -Speed Auto Wash, Inc., 609 East LaSalle Avenue, South Bend, <br />
