REGULAR MEETING NOVEMBER 4, 1991 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: 1. That in consideration of the transfer to the City by the Authority of the following described property, situated in St. Joseph County: A parcel of land being a part of the West half of the Northwest Quarter of the Northwest. Quarter of Section 28 and the East half of the Northeast Quarter of the Northeast Quarter of Section 29, both sections being in Township 38 North, Range 2 East, German Township, St. Joseph County, Indiana, and being more particularly described as follows: Beginning at the Northwest Corner of the Northwest Quarter of said Section 28; thence East on the North Section line of Section 28 a distance of 297.O feet to the Point of Beginning; thence South on a line parallel with the West Section line of Section 28 a distance of 602.9 feet; thence West on a line parallel with the North Section line of Sections 28 and 29 a distance of 737.0 feet; thence North on a line parallel to the East Section line of Section 29 a distance of 602.9 feet; thence East on the North Section line of Sections 28 and 29 a distance of 737.0 feet to the Point of Beginning, containing 10.2 acres, more or less, (hereinafter referred to as "Parcel B"), the following described property situated in St. Joseph County shall be transferred by the City to the Authority: A parcel of land being a part of the East half of the Northwest Quarter of the Southwest Quarter of Section 28, Township 38 North, Range 2 East, German Township, St.. Joseph County, Indiana, and being more particularly described as follows: Beginning point being at the Northeast corner of the Northwest Quarter of the Southwest Quarter of said Section 28; thence South along the North -South Centerline of the Southwest Quarter of said Section 28 a distance of 390.0 feet; thence West on a line parallel with the _East-West Centerline of said Section 28 a distance of 440.0 feet; thence North on a line parallel with the East line of the West half of the West half of said Section 28, a distance of 390.0 feet; thence East on a line parallel with the East-West centerline of said Section 28 a distance of 440.0 feet to the Point of Beginning, containing 3.94 acres, more or less, (hereinafter referred to as "Parcel A"). 2. That Parcel A shall be transferred to the Authority by quit -claim deed, executed by the Mayor of the City of South Bend, and attested to by the South Bend City Clerk. 3. That transfer to the Authority shall be made by the City in an "as is" condition with no warranties, indemnities or representations made by the City to the Authority.
