8 6 <br />REGULAR MEETING <br />NOVEMBER 4, 1991 <br />West on a line parallel with the East-West <br />Centerline of said Section 28 a distance of 440.0 <br />feet; thence North on a line parallel with the <br />East line of the West half of the West half of <br />said Section 28, a distance of 390.0 feet; thence <br />East on a line parallel with the East-West <br />centerline of said Section 28 a distance of 440.0 <br />feet to the Point of Beginning, containing 3.94 <br />acres, more or less, <br />(hereinafter referred to as "Parcel A"), and <br />WHEREAS, the St. Joseph County Airport Authority <br />(hereinafter, the "Authority"), a governmental entity, is the <br />owner of a parcel of real property, situated in St. Joseph <br />County, Indiana, and being more particularly described as <br />follows: <br />A parcel of land being a part of the West half of <br />the Northwest Quarter of the Northwest Quarter of <br />Section 28 and the East half of the Northeast <br />Quarter of the Northeast Quarter of Section 29, <br />both sections being in Township 38 North, Range 2 <br />East, German Township, St. Joseph County, Indiana, <br />and being more particularly described as follows: <br />Beginning at the Northwest Corner of the Northwest Quarter of <br />said Section 28; thence East on the North Section line of <br />Section 28 a distance of 297.0 feet to the Point of Beginning; <br />thence South on a line parallel with the West Section line of <br />Section 28 a distance of 602.9 feet; thence West on a line <br />parallel with the North Section line of Sections 28 and 29 a <br />distance of 737.0 feet; thence North on a line parallel to the <br />East Section line of Section 29 a distance of 602.9 feet; <br />thence East on the North Section line of Sections 28 and 29 a <br />distance of 737.0 feet to the Point of Beginning, containing <br />10.2 acres, more or less, <br />(hereinafter referred to as "Parcel B"); and <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works <br />of the City of South Bend, Indiana (hereinafter, the "Board of <br />Public Works") has custody of all real property of the City of <br />South Bend and is authorized by statute to dispose of City -owned <br />property, pursuant to the requirements of I.C. 36-1-11; and <br />WHEREAS, pursuant to I.C. 8-22-3-10, the Authority is <br />authorized to acquire and dispose of real property for use or in <br />connection with or for administrative purposes of the airport; <br />and <br />WHEREAS, the Authority is desirous of acquiring title to <br />Parcel A from the City so that the same may be added to the clear <br />zone of the Michiana Regional Airport, and is desirous of <br />transferring title to Parcel B to the City; and <br />WHEREAS, the City is desirous of acquiring Parcel B from the <br />Authority and desirous of transferring title of Parcel A to the <br />Authority; and <br />WHEREAS, I.C. 36-1-11-8 provides for the transfer of real <br />property between governmental entities by adoption of <br />substantially equivalent resolutions; and <br />WHEREAS, the Authority has or will adopt a resolution <br />substantially equivalent to this Resolution to effectuate the <br />transfer of Parcel A from the City to the Authority and the <br />transfer of Parcel B from the Authority to the City. <br />
