EN <br />REGULAR MEETING <br />AUGUST 39, 3 9 91 <br />Mr. Frank Mulligan, 17250 McErlain, South Bend, Indiana, <br />Petitioner and General Manager of South Bend Controls, was <br />present and advised the Board that the purpose of the vacation is <br />so he can install a sign in front of his building. <br />Mr. Roger Nawrot, Cole Associates, Inc., 2211 East Jefferson <br />Boulevard, South Bend, Indiana, was also present on behalf of the <br />Petitioner and advised that Mr. Mulligan would like to vacate a <br />portion of the right-of-way between Louise Street and Roberts <br />Street which is approximately 2,874 square feet. Mr. Nawrot <br />noted that the portion to be vacated is an odd shape parcel and <br />the vacation of this property will line up the right-of-way east <br />of Roberts Street, which consists of commercial and industrial <br />use buildings, and the right-of-way west of Louise Street. With <br />this action all of the right-of-way will be in a straight line. <br />Mr. Nawrot further noted that research was not able to reveal why <br />more right-of-way was retained in this particular subdivision <br />than in the others. Mr. Nawrot further noted that there are no <br />utilities in this right-of-way. <br />In conclusion, Mr. Nawrot informed members of the Board that <br />South Bend Controls recently went through a physical plant <br />expansion and the placement of a new sign in front of the <br />building is the final action to complete the package. <br />There being no one else present wishing to speak either for or <br />against the proposed vacation, and no written objections having <br />been filed with the Board, upon a motion made by Mr. Leszczynski, <br />seconded by Mrs. DeClercq and carried, the Public Hearing on this <br />matter was closed. Additionally, there being no questions or <br />comments by members of the Board, Mrs. DeClercq made a motion <br />that the Board submit to the Co:-timon Council a favorable <br />recommendation on the above referred to vacation. Ms. Humphreys <br />seconded the motion which carried. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - VACATION OF THE 1ST <br />N/S ALLEY_E. OF LA PORTE STREET RUNNING SOUTH FROM COLFAX STREET, <br />FOR A DISTANCE OF APPROXIMATELY 200 FEET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on the vacation of the following described <br />alley: <br />The first north/south alley east of LaPorte Street <br />running south from Colfax Street, for a distance <br />of approximately 200 feet. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. Paul Hayden, 914 <br />Lincolnway West, South Bend, Indiana, on behalf of the <br />Petitioner, South Bend Heritage Foundation, owners of property at <br />128 LaPorte, 130-134 LaPorte, 136 LaPorte, 146 LaPorte, 910-912 <br />West Colfax, 906 West Colfax and 902 West Colfax, South Bend, <br />Indiana. <br />It was further noted that pursuant to South Bend Municipal Code <br />Section 18-53-8, owners whose property abut the proposed alley to <br />be vacated as well as property owners within one hundred fifty <br />(150) feet of the alley to be vacated, were notified of the <br />Board's Public Hearing date. <br />Mr. John Shrieve, South Bend Heritage Foundation, 726 West <br />Washington, South Bend, Indiana, was present on behalf of the <br />Petitioner and displayed site plans and photographs of the <br />property to be affected by the proposed vacation and its <br />purpose. He noted that the purpose of vacating this alley is to <br />provide more yard space and landscaping to approximately seven <br />(7) structures as well as to facilitate parking in the area. He <br />noted that all utilities will be relocated should this alley be. <br />vacated. <br />
