REGULAR MEETING <br />AUGUST :19, 1991 <br />Mr. Phil Carlisle, 116 LaPorte, South Bend, Indiana, was present <br />and informed the Board that he received Notice of the Board's <br />Public Hearing but was unclear how this vacation affected him. <br />Mr. Carlisle was shown the photographs and site plans which <br />Indicated that the vacation of this alley would not affect his <br />property. He was informed that the reason he received the Notice <br />was because he lived within one hundred fifty (150) feet of the <br />alley to be vacated and that the Board was required to send him <br />notification of this Vacation Petition. <br />It is noted that the Vacation Petition indicates that the <br />purpose of the vacation is to level existing grade between 906 <br />crhd 910-912 West Colfax and to provide additional yard space for <br />these two (2) properties. Additionally, to provide topsoil and <br />grass seed in the alley behind 128 and 130-132 LaPorte Street to <br />provide more yard space. <br />There being no one else present wishing to speak either for or <br />against the proposed vacation, and no written objections having <br />been filed with the Board, upon a motion made by Mr. Leszczynski, <br />seconded by Ms. Humphreys and carried, the Public Hearing on this <br />matter was closed. <br />In response to her inquiry, Ms. Humphreys was advised that the <br />Board is in receipt of favorable recommendations from the various <br />departments and bureaus who have reviewed this Vacation <br />petition. Therefore, Ms. Humphreys made a motion that the Board <br />forward to the Common Council a favorable recommendation on this <br />vacation. Mrs. DeClercq seconded the motion which carried. <br />PUBLIC HEARING <br />STREET BETWEEN <br />AND TABLING OF RECOMMENDATION - <br />ST. PETER STREET AND NOTRE DAME <br />VACATION OF CEDAR <br />AVENUE <br />Mr. Leszczynski <br />advised that this was the date <br />set for the <br />Board's Public <br />Hearing on the vacation of the <br />following <br />right-of-way: <br />Cedar Street between St. Peter Street and Notre <br />Dame Avenue in South Bend, Indiana <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. William T. <br />Hambling, P.O. Box 1935, South Bend, Indiana, on behalf of the <br />Petitioner, Saint Joseph's Medical Center, 801 East LaSalle <br />Street, P.O. Box 1935, South Bend, Indiana. <br />It was further noted that pursuant to South Bend Municipal Code <br />Section 18-53-8, owners whose property abut the proposed street <br />to be vacated as well as property owners within one hundred fifty <br />(150) feet of the street to be vacated, were notified of the <br />Board's Public Hearing date. <br />Mr. William T. Hambling, 801 East LaSalle, South Bend, Indiana, <br />was present on behalf of the Petitioner and advised that St. <br />Joseph's Medical Center proposes the vacation of the above <br />referred to portion of Cedar Street between St. Peter and Notre <br />Dame Avenue to allow the construction of an office building and <br />relocation of the family practice facilities. <br />Mr. James Humphrey, 836 Miner Street, South Bend, Indiana, was <br />present and advised the Board that he received notification of <br />the Public Hearing today from the Board of Public Works and was <br />present just to see what will transpire with this request. <br />Common Councilman Ann Puzzello was also present and advised the <br />Board that she is not necessarily against the vacation of this <br />portion of Cedar Street but is concerned about this request as <br />this would be the second street that the hospital has closed. <br />
