REGULAR MEETING <br />JULY 29, 1991 <br />WHEREAS, said real property was accepted by the Board of <br />Public Works of the City of South Bend pursuant to Resolution <br />17-1991 adopted on April 29, 1991; and <br />WHEREAS, Resolution 991 of the South Bend Redevelopment <br />Commission and Resolution 17-1991 of the Board of Public Works of <br />the City of South Bond misidentified the common address of said <br />real property as 622 South Columbia, rather than 624-630 South <br />Columbia, which inaccuracy the Board of Public Works is desireous <br />of correcting hereby; and <br />WHEREAS, the City of South Bend has been informed of a need <br />by the Habitat for Humanity of St. Joseph County, Indiana, Inc. <br />for said property in order to construct housing for low-income <br />families on the site of said real property; and <br />WHEREAS, legal counsel for the City of South Bend have <br />examined the Articles of Incorporation of said Habitat for <br />Humanity of St, Joseph County, Indiana, Inc. and have found that <br />the purpose of said corporation is to provide dwelling <br />accommodations and social services for low-income families where <br />no adequate housing exists for them, and further, that said <br />corporation has qualified as a charitable organization exempt <br />from federal taxation under the terms of the Internal Revenue <br />Code Section 501(c)(3) as well as not -for -profit status by the <br />State of Indiana Department of Revenue; and <br />WHEREAS, pursuant to I.C. 36-1-11-1(a)(7), the City of South <br />Bend may transfer property to an Indiana not -for -profit <br />corporation without recourse to the provisions of I.C. 36-1-11, <br />which otherwise govern the disposition of public property; and <br />WHEREAS, the Board of Public Works is satisfied that the <br />transfer of this property to the Habitat for Humanity of St. <br />Joseph County, Indiana, Inc. for the purpose of providing <br />dwelling accommodations for low-income families is a sufficient <br />public purpose to justify the transfer of said real property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS AS FOLLOWS: <br />1. That the transfer of the following described real <br />property by the City of South Bend, acting by and through its <br />Board of Public Works to the Habitat for Humanity of St. Joseph <br />County, Indiana, Inc.: <br />A parcel of land in the Southwest Quarter of Section <br />12, Township 37 North, Range 2 East, City of South <br />Bend, Portage Township, St. Joseph County, Indiana, <br />being Lots 6 and 7 of Birdsell Mfg. Co. Subdivision as <br />recorded in Book 1, Page 48 at the St. Joseph County <br />Recorder's office in South Bend, Indiana and described <br />as follows: <br />COMMENCING at an iron on the Northwest corner of Lot 9 <br />in Birdsell Mfg. Co.'s Subdivision and also being on <br />the East right-of-way line of Columbia Street; thence <br />South 00000105" West (bearing assumed), 87.00 feet <br />along said East right-of-way line to the Point of <br />Beginning; thence North 88021'17" East, 134.70 feet to <br />the West right-of-way line of a 10.00 foot alley; <br />thence South 00000105" West, 101.00 feet along said <br />West right-of-way line; thence South 88021117" West, <br />134.70 feet to the East right-of-way line of Columbia <br />Street; thence North 00000105" East 101.00 feet along <br />said East right-of-way line to the Point of Beginning, <br />and containing 0.3123 acres, more or less, and is <br />subject to all easements, restrictions and or covenants <br />of record, more commonly known as 624-630 South <br />Columbia, South Bend, <br />
