<br />In conclusion, Mrs. Manier noted that all these properties are
<br />located within the Monroe Park area and are in conjunction with
<br />the 1990 South Bend Central Business District Tax Incremental
<br />Financing Bond Project.
<br />Therefore, Ms. Humphreys made a motion that the Resolutions as
<br />submitted be adopted and the Sublease Agreements as submitted
<br />with the appropriate Resolutions be approved. Mrs. DeClercq
<br />seconded the motion which carried and the following Resolution
<br />Nos. 17-1991, 18-1991, 19-1991, 20-1991, 21-1991, 22-1991 and
<br />23-1991 be adopted and the Sublease Agreements be approved:

<br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS
<br />OF THE CITY OF SOUTH BEND, INDIANA,
<br />APPROVING THE TRANSFER OF REAL PROPERTY
<br />FROM THE SOUTH BEND REDEVELOPMENT COMMISSION
<br />WHEREAS, the South Bend Redevelopment Commission owns the
<br />following described real property situated in St. Joseph County,
<br />Indiana:
<br />A parcel of land in the Southwest Quarter of Section 12,
<br />Township 37 North, Range 2 East, City of South Bend, Portage
<br />Township, St. Joseph County, Indiana, being Lots 6 and 7 of
<br />Birdsell Mfg. Co. Subdivision as recorded in Book 1, Page 48
<br />at the St. Joseph County Regorder's office in South Bend,
<br />Indiana and described as follows:
<br />COMMENCING at an iron on the Northwest corner of Lot 9 in
<br />Birdsell Mfg. Co.'s Subdivision and also being on the East
<br />right-of-way line of Columbia Street; thence South 00000105"
<br />West (bearing assumed), 87.00 feet along said East
<br />right-of-way line to the Point of Beginning; thence North
<br />88021117" East, 134.70 feet to the West right-of-way line of
<br />a 10.00 foot alley; thence South 00000105" West, 101.00 feet
<br />along said West right-of-way line; thence South 8802111711
<br />West, 134.70 feet to the East right-of-way line of Columbia
<br />Street; thence North 00000105" East 101.00 feet along said
<br />East right-of-way line to the Point of Beginning, and
<br />containing 0.3123 acres, more or less, and is subject to all
<br />easements, restrictions and or covenants of record. Commonly
<br />known as 622 South Columbia Street, South Bend, (the "Real
<br />Property"); and
<br />WHEREAS, the Commission, in Resolution 993, adopted April 26,
<br />1991, expressed its desire to transfer the Real Property to the
<br />City of South Bend, Indiana; and
<br />WHEREAS, the City of South Bend is desirous of accepting the
<br />transfer of the Real Property from the Commission; and
<br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works
<br />of the City of South Bend (the "Board") has custody of and may
<br />maintain_ all real property of the City of South Bend; and
<br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend,
<br />acting by and through the Board, may exchange or transfer
<br />property with another governmental entity upon terms and
<br />conditions agreed upon by the two (2) entities as evidenced by
<br />the adoption of substantially identical resolutions of each
<br />entity; and
<br />WHEREAS, the Commission has agreed to transfer the Real
<br />Property to the City of South Bend, and the City of South Bend,
<br />acting by and through the Board, has agreed to accept the
