<br />above described land, in St. Joseph County, Indiana, Key Nos.
<br />18-1044-1914, commonly known as 106-110 North Walnut, South
<br />Bend,
<br />and
<br />A lot or parcel of land 33.75 feet in width, East and West,
<br />taken off of and from the entire length of the West side of
<br />Lot Numbered Two (2) and all of Lot Numbered Three (3) as
<br />shown on the recorded Plat of Studebaker and Hines'
<br />Subdivision of the Southern part of Bank Out Lot Numbered 80
<br />of the Second Plat of Out Lots of the Town, now City of South
<br />Bend, St. Joseph County, Indiana, platted by the State Bank of
<br />Indiana, Key Nos. 18-1045-196001, commonly known as 1307-11
<br />West Washington Street, South Bend,
<br />(collectively referred to herein as the "Real Property"); and
<br />WHEREAS, the South Bend Redevelopment Department, on behalf
<br />of the South Bend Redevelopment Commission, has made a request to
<br />the Board to purchase the Real Property, which property it
<br />intends to redevelop as part of its West Washington -Chapin
<br />redevelopment project; and
<br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend,
<br />acting by and through The Board, may exchange or transfer
<br />property with another governmental entity upon terms and
<br />conditions agreed upon by the two (2) entities as evidenced by
<br />the adoption of substantially identical resolutions of each
<br />entity; and
<br />WHEREAS, the South Bend Redevelopment Commission, governing
<br />body of the South Bend Redevelopment Department, is desirous of
<br />acquiring the Real Property and has reached agreement with the
<br />Board upon the terms and conditions of the acquisition of the
<br />Real Property.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
<br />OF THE CITY OF SOUTH BEND, AS FOLLOWS:
<br />1. That the transfer of the following described property,
<br />situated in St. Joseph County, by the City of South Bend,
<br />Indiana, acting by and through its Board of Works, to the City of
<br />South Bend, for the use and benefit of its Department of
<br />Redevelopment:
<br />Part of Lot "A" and Lot One Hundred Seven (107) on the
<br />recorded Plat of Commissioners Subdivision of Bank Out Lot
<br />Seventy-nine (79) of the second plat of out lots of the town,
<br />now City of South Bend, platted by the State Bank of Indiana
<br />which part is bounded by a line as follows, viz: Beginning
<br />on the East line of North Walnut Street at a point
<br />seventy-eight (78) feet North of the Southwest corner of said
<br />Lot "A", thence East Sixty-six (66) feet to the East line of
<br />said Lot One Hundred Seven (107), thence North on said line
<br />Fifty-two (52) feet, thence West Sixty-six (66) feet to the
<br />West line of said Lot "A", thence South on said line
<br />Fifty-two (52) feet to the place of beginning, together with
<br />the right to use in common with adjoining owners to a private
<br />right of way eight (8) feet in width located next South of
<br />and adjoining the above described land, in St. Joseph County,
<br />Indiana, Key Nos. 18-1044-1914, commonly known as 106-110
<br />North Walnut, South Bend,
<br />and
<br />A lot or parcel of land 33.75 feet in width, East and West,
<br />taken off of and from the entire length of the west side of
<br />Lot Numbered Two (2) and all of Lot Numbered Three (3) as
<br />phown on the recorded Plat of Studebaker and Hines'
