REGULAR MEETING <br />DECEMBER 7, 1992 <br />Also, the Fire Department has indicated that they would approve <br />of this vacation contingent on the Fire Department having access <br />to the garage at 912 Oakland and the buildings in back of 1408 <br />and 1412 Mishawaka Avenue. Additionally, the Engineering <br />Department, Police Department and Legal Department have no <br />objections to this vacation. <br />Board Attorney and Member Mary H. Mueller informed members of the <br />Board that it has come to her attention that the Petitioner was <br />in the process of acquiring one of the properties which the Area <br />Plan Commission and Fire Department are concerned about. She <br />noted that the Common Council will notify everyone who owns <br />property on the alley about a Public Hearing concerning this <br />Vacation Petition. Mrs. Mueller further noted that according to <br />the ordinance filed with the Vacation Petition, the Petitioner <br />intends to utilize this alley for contiguous parking between <br />Taylor and Moyer Insurance office and the proposed parking south <br />of the corporate office. There appears to be no problem if in <br />fact Taylor and Moyer intends to buy the property with the garage <br />that accesses this alley. <br />Mr. Larry Spradlin, Sr., Division of Engineering, addressed the <br />Board regarding this matter and stated that it is his belief that <br />the Petitioner intends to have this alley remain open and it will <br />be curbed at the north/south alley. The alley will deadend at <br />the north/south alley for parking on the opposite side of the <br />business. If there has been no negotiations with the owners with <br />the garage the City may want to require an Easement until they <br />purchase that property. The alley is the only access to the <br />garage in question. <br />Mr. Caldwell inquired if the owners of the property with the <br />garage that accesses onto the alley are aware of this pending <br />vacation. Mr. Spradlin indicated that he believes that they are <br />and reiterated that the alley will remain open and they would <br />still have the access to their garage. Further, in response to <br />an inquiry from Mrs. Mueller, Mr. Spradlin indicated that the <br />Fire Department will have access. Mr. Caldwell questioned <br />whether or not the Board should indicate that an Easement would <br />be required. Mrs. Mueller noted that the City reviews these <br />petitions on the basis of public access and the mentioned <br />Easement would be between the individual property owners. Mr. <br />Leszczynski agreed with Mrs. Mueller. Therefore, Mrs. Mueller <br />noted that since the Fire Department's concerns would be met and <br />they will have access should it be required, she made a motion <br />that the Board submit to the Common Council a favorable <br />recommendation concerning this alley vacation. Mr. Caldwell <br />seconded the motion which carried. <br />APPROVE REQUEST OF SUNSHINE PRODUCTIONS FOR TRAFFIC AND PARKING <br />ARRANGEMENTS IN CONJUNCTION WITH THE FILMING OF THE MOVIE 'RUDY" <br />- DECEMBER 9, 1992 <br />In a Memorandum to the Board, Ms. Mikki Dobski, Office of the <br />Mayor, requested permission, on behalf of Sunshine Productions, <br />to utilize the following traffic and parking arrangements for <br />Wednesday, December 9, 1992, from 5:00 a.m. to 10:00 p.m. in <br />conjunction with the filming of the movie "Rudy": <br />Wall Street, between Greenlawn and Twyckenham, south <br />side only - No Parking <br />Mishawaka Avenue, first 100 feet east of Twyckenham, north <br />side - No Parking <br />Kid's Kingdom Parking Lot- No Parking (approved by the Park <br />Department) <br />School buses will load on Twyckenham - South Bend Police <br />1 <br />
