<br />November 16, 1992, a proposed lease agreement ("Proposed Lease")
<br />concerning the lease of the Premises as petitioned; and
<br />WHEREAS, the City of South Bend operates the St..Joseph
<br />County/South Bend Building Department under the direction of the
<br />Consolidated Building Board; and
<br />WHEREAS, I.C. 36-1-10-7(2) requires, prior to the Board of
<br />Public Works entering into a lease agreement for said Premises,
<br />that the South Bend Common Council, after investigation,
<br />determine that the lease of the Premises are needed.
<br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works
<br />of the City of South Bend, Indiana, as follows:
<br />1) The Board of Public Works of the City of South Bend,
<br />Indiana, hereby expresses its desire and intent to lease office
<br />space at Suite 100, 205 West Jefferson Boulevard, South Bend,
<br />Indiana, for the use and benefit of the St. Joseph County/South
<br />Bend Building Department.
<br />2) That remodeling of said Premises is necessary in order
<br />to convert said Premises into fully functioning, usable office
<br />space for the Building Department, which remodeling is estimated
<br />to cost Twenty-four Thousand Eight Hundred Twenty-five Dollars
<br />($24,825.00).
<br />3) That preliminary plans, specifications and estimates of
<br />the proposed renovations submitted to the Board on November 16,
<br />1992, are hereby accepted for filing and are made available for
<br />public inspection.
<br />4) That the Petition, as certified by the St. Joseph County
<br />Auditor and submitted to the Board on November 16, 1992, is
<br />hereby accepted for filing and made available for public
<br />inspection.
<br />5) That the lease of the Premises shall be for a term of
<br />two (2) years, with a one (1) year extension at the City's
<br />option, and with the annual rental not to exceed Twenty-four
<br />Thousand Dollars ($24,000.00) the first year, Twenty-five
<br />Thousand Two Hundred Dollars ($25,200.00) the second year, and
<br />Twenty-six Thousand Four Hundred Dollars ($26,400.00) the third
<br />year, if the option to extend is exercised by the City.
<br />6) That the Proposed Lease for the Premises submitted to
<br />the Board on November 16, 1992, is hereby accepted for filing and
<br />made available for public inspection.
<br />7) That the Board directs and authorizes the Building
<br />Commissioner as its agent to file with the Consolidated Building
<br />Board a form of resolution to establish, after investigation and
<br />consideration, its approval of the lease of the Premises as set
<br />out herein.
<br />8) That the Board directs and authorizes the Building
<br />Commissioner as its agent to file with the City Clerk for
<br />consideration by the Common Council of the City of South Bend,
<br />Indiana, a form of resolution to establish, after investigation
<br />and consideration, its determination that the lease of the
<br />Premises described herein is needed.
<br />9) That a public hearing on the Proposed Lease is hereby
<br />set for November 30, 1992, at 9:30 a.m., in the Board of Public
<br />Works Meeting Room, 1308 County -City Building, South Bend,
<br />Indiana, 46601, at which hearing all persons wishing to be heard
<br />will be given the chance to address whether the Proposed lease is
<br />necessary and whether the proposed rental is fair and reasonable.
