<br />agreements between the parties to reflect a few changes including
<br />indication that the lease is subject to annual appropriations and
<br />that certain improvements will be made at the owners expense as
<br />well as language concerning insurance. All other terms of the
<br />Agreement remain the same as originally filed. In conclusion,
<br />Ms. Manier asked for the Board's favorable consideration and
<br />approval of the lease and adoption of the Resolution.
<br />There being no one else wishing to address the Board regarding
<br />this matter, Mr. Leszczynski made a motion that the Public
<br />Hearing be closed. Mr. Caldwell seconded the motion which
<br />carried.
<br />Additionally, Mr. Caldwell made a motion that the Board adopt
<br />Resolution No. 31-1992 confirming its intent to Lease office"
<br />space for use of the Department of Economic Development and
<br />approve and execute the Office Building Lease. Mrs. Mueller
<br />seconded the motion and the following Resolution No. 31-1992 was
<br />adopted:

<br />WHEREAS, the Board of Public Works of the City.of South Bend,
<br />Indiana ("Board"), on August 10, 1992, adopted a Resolution
<br />30-1992 entitled A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE
<br />CITY OF SOUTH BEND, INDIANA, DECLARING ITS INTENT TO LEASE OFFICE
<br />SPACE AT 205 WEST JEFFERSON BOULEVARD, SOUTH BEND, INDIANA, FOR
<br />THE USE OF THE CITY OF SOUTH BEND, DEPARTMENT OF ECONOMIC
<br />DEVELOPMENT, DIVISION OF PLANNING AND NEIGHBORHOOD DEVELOPMENT
<br />("Resolution"), in which it declared its intent to lease office
<br />space at Suite 416, 205 West Jefferson Boulevard, South Bend,
<br />Indiana ("Premises"), for the use of the City of South Bend,
<br />Department of Economic Development, Division of Planning and
<br />Neighborhood Development, from the Jefferson Street Partnership
<br />of South Bend, Indiana, for a term of three (3) years, with the
<br />annual rental of said premises, as remodeled to meet the.needs of
<br />the Division of Planning and Neighborhood Development, not to
<br />exceed Twenty Thousand Dollars ($20,000.00); and
<br />WHEREAS, the proposed lease plans, specifications, and
<br />estimates of the costs of the proposed remodeling were submitted
<br />to and filed with the Board and have been made available for
<br />public inspection; and
<br />WHEREAS, the Resolution provided for public hearing on August
<br />31, 1992, at 9:30 a.m., in the Board of Public Works Meeting
<br />Room, 1308 County -City Building, South Bend, Indiana 46601, at
<br />which hearing all persons wishing to be heard could address the
<br />Board as to whether the execution of the proposed lease is
<br />necessary and whether the proposed rental is fair and reasonable
<br />for the premises; and
<br />WHEREAS, pursuant to I.C. 36-1-10-13, notice of the public
<br />hearing on the proposed lease was published one (1) time in the
<br />South Bend Tribune and Tri-County News on August 14, 1992; and
<br />WHEREAS, the public hearing was held pursuant to the notice
<br />and the Resolution, no written remonstrances were filed, and all
<br />interested persons were heard at the public hearing; and
<br />WHEREAS, on August 24, 1992, the South Bend Common Council
<br />adopted Resolution 1969-92 entitled A RESOLUTION OF THE SOUTH
